This gives the Left a chance to yell activist. While I see the result as a good, how does a conservative court or justice make a ruling on an issue that was not argued before the Court? This recalls Scott v Sanford. Sanford’s lawyers argued that Scott had no standing to bring suit. Taney and the majority could have stopped there but they went far beyond. Denying black citizenship and overturning both the Missouri Compromise and Popular Sovereignty regarding slavery.

Baloney. The union stance is that they will just take the money and force you to get it back via lawsuit. Opt-out enables that even more. The court was striking down the union hardball tactics resulting in violation of people's 1st Amendment. They are basically restoring their rights in a tangible rather than theoretical way.
