The thesis appears to be that just as the Congress can tax the purchase of gasoline, so can it tax the non-purchase of gasoline and therefore the non-purchase of insurance.
This is insanity. You can be taxed for NOT doing something or not buying something.
Citizen: "But I don't want to buy a Chevy Volt"
Govt.: "Fine, just pay the 2500 tax, and we'll be even".

In reality that is already happening. Buy a Chevy Volt and get a tax credit. Buy a gas powered car and don’t get a tax credit.
I actually think Roberts lost his mind. He voted the exacty opposite of what he said during oral arguments. Or was the solicitor general better than people thought.
