“Absurd”… “Internally Contradictory”.

It’s a tax… it’s a penalty… no, wait…it’s a tax. Chief Justice John Roberts turned the Constitution and the Supreme Court on its head with a not-quite-coherent opinion in which he managed a tortured interpretation of the Obamacare Act, which was clearly intended to save the most detested piece of legislation since prohibition.

The temptation to jump on my keyboard as soon as I heard the announcement was severe. As with most news events, I prefer to wait until the immediate coverage has sorted itself from the garbage which so often accompanies events such as this. I’m glad I did. It gave me the opportunity to listen to the opinions of one of the true experts on the Constitution and Constitutional law in this country, Mark Levin.

For those of you seeking information you could not find a better, more coherent source than Mr Levin. His book, ‘Men in Black’, is a compelling look at the Supremes and their relationship to jurisprudence and the Constitution. His book,’Liberty and Tyranny’, is a tour de force which offers a compelling insight into the minds and actions of those who would destroy America as we know it.

Mark was as close to ballistic in his treatment and analysis of the Roberts decision as anything I’ve ever heard him say or write. Words such as “Mickey Mouse”… and… “There’s nothing redeeming about Obamacare, nothing”. To say that he filetted the opinion of the Chief Justice is a wild understatement.

Roberts found a political reason to render the judgement as he did. Had he not convoluted his reasoning along the tortuous path he chose, Obamacare would have gone down in the flames it so richly deserves. As it is, Roberts’ legacy to the court and the nation is going to be one of eternal vigilance on our part. The usual beltway pundits are falling all over themselves to posit this mess as some sort of conservative victory.

The only victory here is that there’s probably nothing that could have galvanized an already aroused conservative patriot populace more. Everything I’m hearing out here and reading online indicates a real anger over upholding a clearly unconstitutional law, which was passed in the ‘dark of night’ without a single Republican vote and not a single committee hearing.

For myself, November just can’t get here fast enough.

Unfortunately, the bravado produced by this enabling device will bring about more freedom destructing rules, regulations and an emboldened press/media that will take more than years ... perhaps three or four American (I'm tired of Conservatism and Conservatists .. they don't seem to "get it" nor get things done) administrations.

Why is there no American party?

Roberts is a muddled thinker. Not quite the legal genius he was made out to be when W nominated him.

Unfortunately, the bravado produced by this enabling device will bring about more freedom destructing rules, regulations and an emboldened press/media that will take more than years ... perhaps three or four American (I'm tired of Conservatism and Conservatists .. they don't seem to "get it" nor get things done) administrations.

I believe it will sevre to galvanize Tea Party Conservatives and some State Govs, but it will also serve as the Left considering a violent put-down of all who oppose it to be "justified"..

Why would Roberts write something that seems so strange and illogical? It is almost as if he wrote something really bizarro to attract attention and to let everybody know, in a coded way, that he was being forced. For this thought to enter my mind just shows how very tortured his explanations seem for a supposedly sane, thoughtful person. It comes across as in a mystery movie when a hostage is on the phone and says something the person on the other end of the phone will KNOW is out of place, such as “Tell aunt Mary I’m thinking of her” when there is no aunt Mary.

Robert's opinion has written all over it that he was under ‘supreme’ duress. He simply is not this dumb. Individuals can get very incoherent when their loved ones lives are being threatened if they do not meet the extortionists demands. This is what I see evidenced in this opinion. A last minute ultimatum delivered to Roberts to do it our way or you will pay dearly. Though he gave them what they demanded, he still managed to mete out a few surprises for the statists.

The entire body of US law is internally contradictory.

When 4 justices use well reasoned arguments based on law and precedent to prove “A” and 5 justices use well reasoned arguments based on law and precedence to prove “NOT A” then the body of law and precedence MUST logically be internally contradictory.

Which means all legal decisions are totally arbitrary.

During the next two weeks he will be taking part in a summer programme offered by Boston’s New England Law. He will also serve as a faculty member at the University of Malta’s Foundation for International Studies.

Together with Harvard Professor Richard Lazarus, Dr Roberts will be teaching a credit called the US Supreme Court in Historical Perspective.

I disagree. There has been an undercurrent of this kind of thinking since the ruling, that Roberts simply couldn’t have been so evil or misguided to have actually wanted to rule the way he did, someone must have forced him to do it. Bullshit. For whatever reason, Roberts did what he wanted to do, and to hell with the rest of us. I won’t let him off the hook, he is responsible for everything that comes after this ruling.

What the H*ll is wrong with Conservatives?? The decision is Robert's and Robert's alone. Please quit trying to read more into it.

Maybe Obama's thugs got to him? Maybe his wife is a flaming Liberal on Heath care matters, maybe he is gay?? I read all these hypotheses.

Let's assume that Roberts was pressured somehow to change his vote. So what??

In the end it was Robert's and his decision alone. Robert's owns this 100.00%

With this decision Robert's has shown himself to be an extremely evil human being.

No one who cherishes our Constitution and has a strong love of Liberty would have made such a decision.

Only a rabid Statist, someone who feels themselves superior to others, would cast such a vote. Roberts worships at the alter of State Power.

Please don't try to excuse Roberts. View this subhuman scum for what he is: an extremely evil human being who has put a final nail into our Freedoms.

You are exactly right.

Roberts made a decision to enshrine (or at least protect) himself in what he sees as the bright light of posterity.

He did exactly what George H.W. Bush did on question of tax increases, Bart Stupak chose to do on the health care bill, what Angela Merkel did just a few days ago in choosing to endorse yet another bailout of the braindead Euro.

He caved because the pressure of D.C., of the media, of the intense personal desire of the narcissist (yes, he’s another) to be loved.

Ironically Roberts has long fashioned himself to be a scholar of Lincoln and an heir to his tradition.

Imagine Lincoln in his moment of crisis tearing up the Emancipation Proclamation and declaring (tearily) instead, “Can’t we all just get along?”

That would be failure, cowardice and ignominy.

That is John Roberts.

This is a result of case-law instead of constitutional law; the courts have elevated 'precedent' to a level superior to the constitution, and there are enough bad rulings out there they can make their opinion say whatever the hell they want.
