Professor Urges Constitution Be Abandoned (Satire)

In an op ed piece for the New York Times, Georgetown Professor of Constitutional Law Louis Seidman asserts that “obedience to the Constitution blocks implementation of measures those in a position to know best want to enact.”

“The heralded ‘checks and balances’ inflicted on us by this archaic document stifle the beneficence of wise leaders like President Obama,” Seidman wrote. “Unconstrained by the outdated philosophy of the nation’s founders, President Obama could easily bring a new era of social justice to America and the world.”

Seidman cited the imperfections of the men who wrote the Constitution as grounds for rejecting their work. “The so-called freedoms of speech and religion, the right to bear arms, and the idea of limited government are the values of dead white males,” the professor continued. “The women, minorities, and poor who were excluded from participating then should not today be bound to respect them.”

Calling the notion of individual freedom a “false consciousness,” the op ed argued for “the more robust freedom of ‘total democracy’ where society acting collectively can make and remake the rules under which they choose to live. Why should the majority be forced to tolerate the speech of a disruptive minority or be prevented from disarming enemies of the state? Modern times call for modern ideas to supplant reverence for the past.”

Saw the guy on Fox News yesterday with Megyn Kelly-

His basic premise is that of so many today - laws and sociatal mores are situational. And today, what is right is wrong 6 months from now and so forth. Short term profits, short term laws, short term and so forth. It all fits.

My favorite line of his was that the writers of the Constitution are not representative of our country today.

To which I say, “Well, duh!”

An Americans urge this ‘professor’ to abandon the US and get the hell out- If he doesn’t support the cosntitution, then he doesn’t lvoe thsi great nation and doesn’t belong here- period- I can’t beleive he’s even a teacher-

So, let's throw out the constitution.
THEN WE HAVE NO FORM OF GOVERNMENT. Who becomes leader, and why, what law is there and how do we get new laws. It would seem to me that we would be faced with open warfare across the country and soon we would establish warlords all around the country. I know that I would certainly like to be the leader so I would try to build a strong personal army to help repress the populace. Wow, this sound like the makings for a great movie.

It’s funny because the U.S. really doesn’t follow its own constitution. Seriously. Would the founding fathers really envision today’s government and all its expansive powers as a product of their constitution?

Note to Georgetown Professor of Constitutional Law Louis Seidman: Professor, you can have the rule of law and accept its imperfections, or you can have the law of the jungle where it becomes survival of the fittest. You cannot have both.

Being an academic type, I think you are manifestly unsuited to survive and thrive under the law of the jungle. Actually, you might be a tasty appetizer for a high end predator. Yummy.

anyone who thinks that the founders where semi-tyrants who only wanted to preserve their own power in the writing of the Constitution only need to hear the words of this moron to understand that the Founders were completely, 100% correct in their fear of a direct democracy, and their idea to separate the powers of government among many different necessary and equal factions was the right direction.

Only when the ill intentioned made changes and broadened some ideas ... until they were perverted did things really begin to deteriorate. God help us.

This produced the most successful nation ever and established it for the years we actually lived supporting the Constitutional LAW of the land.

When we began to digress away ... is when we started down.

Always remember to judge by the results we get.

What we get today is crushing debt, crushing restrictions in the process of the coming, Agenda 21,EPA ... dangerous threats, and binding regulations. Repressed economy.

This is what is happening now, and it is not for the good. It is the evil of corrupted thinking ... of Tyranny at the gate. The list is long and it has been accumulating and abetting immoral hedonistic behavior.

Are we really going to FACEBOOK, TEXT, IPHONE, AND ENTERTAIN OUR SELF INTO SLAVERY WILLINGLY?

If the constitution is to be abandoned, then the first new law should be to outlaw socialism and communism, progressivism, liberalism, leftism, social-democracy, and acts calculated to advance these things under any other name. Islam is outlawed as well, and Muslims will be deported from the US in an orderly manner.

The next set of laws will be expanding the list of criminal offenses that can receive the death penalty to many violent crimes and perversions. When a jury gives a death penalty, it shall be carried out within three days.

Too bad the left so hated the constitution that they destroyed it. But now that it’s gone, there is no more reason to hoard up leftists or other scoundrels.

So once they’re gone, we can put ourselves to the task of writing a new constitution, ironing out some of the bugs of the last one.

I believe the lawlessness in the times predicted in the Bible is just about here. The liberal want the protections and freedoms of the Constitution that they approve of but not any that have anything that would stop the very government they so trust blindly and naively. They are too stupid to believe that the very government they think has their back also has a sniper’s crosshairs beaded in on their very foreheads. The American left recognized that the Constitution, understood as written and intended, would never allow socialism. They also recognized that the amendment process was too difficult and slow. That is why they developed the "living Constitution" idea back in Wilson's time. They have been termiting away based on this pernicious theory ever since.

Actually, about 80 million gun owners and a large portion of the military are the only thing between us and the democrat/liberal/communist dictatorship that the dems want.

It always surprises me to hear people talk about the relativity of law or morals like that, as if they’ve unconvrred something. Forget the Constitution, forget Aristotle, even. Go back to the decalogue. What does it mean for adultery to be against the covenant? It was the olden days, so the rule must be absolute an unbending. But in order to apply it, you must inquirer into various things. The act itself, what it consists of. Who was involved, when and where. What their status was. How the community viewers them. And so on and so forth.

In other words, it was all situational, and the right and wrong of it relative to particular circumstances. It is possible to be more or less situational, I suppose, and for rules to be more or less flexible, wider or narrower in application. But all the guy you’re talking about, if I may be so bold to guess, was probably advocating is some different set of rules, maybe even stricter, with which to replace old ones.

Relativity is a much abused concept. I think back to Hamlet, where at some point he says they must have grounds more relative, meaning a stronger basis for believing. Protagoras and his “man is the measure” philosophy is much more what people mean by bad relativity, but it is not the real danger. I much rather fear bad morality than loose morality. Hardly anyone ever gets to Anything Goes, but that too is scary.

I wish others would be so intgellectually honest. Even though this article is a mix of fantasy and reality, you have to wonder if Harry Reid et al will really try to run such legislation to at least repeal the Bill of Rights.
