Lawmaker: Doctors shouldn't be asking patients about guns By Pete Kasperowicz - 01/16/13 03:33 PM ET
Rep. John Fleming (R-La.), who was a family physician before coming to Congress in 2009, argued on Wednesday that doctors have no right to ask patients about their status as gun owners, as an executive order from President Obama would encourage them to do.
"I came to Congress as a family physician with great concerns about the federal government intruding on the doctor-patient relationship," Fleming said. "By his executive actions today, President Obama is pushing the government further into the exam room.
"He's trying to press doctors into government service by pushing them to ask patients, even child patients, if there are guns in their home. After more than thirty years of operating a family practice, I can tell you it should not be the business of a family physician to take inventory of the guns in a patient's home."

People lie to their doctors all the time...
Mark
Doctor: Do you own a gun?
Patient: Do you have sex with farm animals?
Doctor: “Do you own a gun?”
Patient: “I’d tell you, but that would only spoil the surprise.”
How is this really any different than anyone asking you? I’ll talk to just about anyone about my guns. We do it here on FR all the time.
Obama is a communist, dictator piece of crap
it must be impeached
Obama is a communist, evil, piece of crap dictator that must be impeached. It uses a statistically nonexistent event to take away our rights and freedom .
These stupid mass shootings are statistically NONEXISTANT events. the news media has made this mass shooting the event that everyone is talking about for the last month.
Less than 100 people get killed in mass shootings per year.
Criminals rape 300,000 women per year in the U.S.
Criminals invade 2.5 million homes per year . These last 2 are real events and threats.
100,000 Americans dies each year in accidents.
millions of Americans die in the U.S. each year of causes not by a mass shooter only less than 100 do.
There are 50, events per year where lighting kills Americans. There are just a handful now of mass shooting events. but the news media makes sure that every mass shooting is reported on trillions of times to every American and that the shooter is world famous more so than any star.
Mass shootings didn’t happen in the 1800s or did so with even less frequency then. the news media causes these events now as that is where they get the idea to copy cat and also some to become famous
Most people do not know that Obamacare has already instituted a so-called “Wellness Exam”, which is nothing more than a questioning session done by a nurse of Medicare patients.
This, of course is only done in the quest for cost savings and prevention according to the government. The question regarding guns in the home, I am certain will be added to the list.
“The annual wellness visit, which has been offered by Medicare since January of 2011 as part of the Affordable Care Act signed into law two years ago by President Obama, is seen as a way to get seniors medical care upfront to avoid a costly hospitalization down the road.
“The wellness visit is not a physical exam but a way for a doctor to talk to the patient and ask questions about chronic conditions like diabetes or depression.”
“The term physical is often used to describe wellness care. But Medicare does not pay for a traditional, head-to-toe physical. Medicare does pay for a wellness visit once a year to identify health risks and help you to reduce them. At your wellness visit, our health care team will take a complete health history and provide several other services:
” Screenings to detect depression,....”
“a personal risk assessment (including any mental health conditions);”
“a review of functional ability and level of safety;”
“a review of the initial personal risk assessment;”

My doctors and nurse practitioners at the VA medical system are already asking this as part of their routine questioning. Hmmmm, why would the Obama administration want to sieze firearms from veterans?
Doctor: Do you own a gun?
Patient: You are not on the “need to know” list for that information.
"Daddy has big, scary guns"
My doc can ask all he wants, and I’ll refuse to answer.
But, then again, he won’t. He’s my academy classmate and he thinks the same of the Obamadork as I (and the vast, vast, VAST majority of my class) do.
Actually, I’d consider poor performance reports on ANY military individual who supports the dork.
It’s just plain poor judgement, and indicates that that individual has not read the constitution.
Of course, the real test will come when the military has to make certain decisions.
With ObamaCare, once they know who have and don’t have guns, they can decide if who gets health care insurance or not. If you don’t get health care insurance, you are breaking the law and will be assessed a penalty tax until you do get insurance. Nudge!

Coburn wants decisions by judge rather than VA for impaired troops By David Sherfinski
The Washington Times
Monday, December 3, 2012
Sen. Tom Coburn, Oklahoma Republican, wants veterans who have been deemed “mentally incompetent” to have their cases adjudicated by a judge rather than the Department of Veterans Affairs, as happens currently and argued that veterans who simply cannot support themselves financially are needlessly given the label and, as such, cannot buy or possess firearms.
“We’re not asking for anything big,” Mr. Coburn said Thursday evening on the Senate floor. “We’re just saying that if you’re going to take away the Second Amendment rights ... they ought to have it adjudicated, rather than mandated by someone who’s unqualified to state that they should lose their rights.”

I see my doc once a year for an annual inspection. At least half of the visit is dedicated to sharing firearms and hunting stories. He’s not participating in the “game”.
The arrogant ass in the white house doesn't care about law. In his mind (and the minds of his upporters) he's been elected dictator so that every whim of his narcissistic personality must be followed by the masses of us common citizens
Patient: "Does your mama still swim out to troop ships?"
People lie to their doctors all the time...
If I could set off a bell that chimed every time a patient lied in the exam room it would sound like a friggin alarm clock.
And that is only when I am sure they lied to me.
I work in pediatrics and Drs have been asking the parents for a number of years,”Do you feel safe in the house,do you have any guns in the house?”
How many years have they been asking this?
More than 5 years.

Florida Law Prohibiting Doctors From Asking Gun Questions Brings Lawsuit
A bill banning Florida physicians from asking patients about gun ownership, signed into law last week by Governor Rick Scott (R), has brought out more than the typical hue and cry from the anti-self defense crowd.
On Monday, the Brady Center to Prevent Gun Violence, along with the Florida chapters of the American Academy of Pediatrics (AAP), the American Academy of Family Physicians, and the American College of Physicians, filed a lawsuit seeking to throw out the new law.
While claiming the new law violates doctors First Amendment rights, the lawsuit hardly conceals its bias against gun rights.
By severely restricting such speech and the ability of physicians to practice such preventative medicine, the Florida statute could result in grievous harm to children, adolescents, adults, and the elderly, according to the motion filed Monday in federal court in Miami.
No mention is ever made, of course, of the grievous harm that is prevented because of lawful gun ownership. In fact, a wide range of studies show that self-defense uses of firearms dramatically outweigh accidents and the criminal misuse of guns. Doctors who discourage gun ownership actually make people less safe and more vulnerable to criminal attack.

I would ask the good Doctor if he has applied to the government for approval of his question to me.
If he can’t show me proof, then he’s an unregistered user of the First Amendment, and I’ll refuse to answer.
No - but my mama has lots of them.

Gov. Scott fires back with appeal of ‘Docs-vs-Glocks’ ruling
Gov. Rick Scott is appealing yet another court ruling, and appears convinced that his interpretation of the Constitution is more valid than that of the federal judge who struck down the so-called Docs-vs.-Glocks law, which banned doctors from asking patients about gun ownership in most cases.
The 2011 law, sponsored by Rep. Jason Brodeur, R-Sanford, was pushed by the National Rifle Association and opposed by Florida doctors. The doctors challenged the law in court, and a federal judge in Miami ruled that barring doctors from asking patients about gun ownership violates their First Amendment freedom of speech rights.
Scott is now appealing that ruling, which pits the First Amendment against the Second Amendment.
Heres the release from Scotts office.
Tallahassee, Fla. The Department of Health today filed an appeal to the federal court decision blocking enforcement of the Firearm Owners Privacy Act. This law was carefully crafted to respect the First Amendment while ensuring a patients constitutional right to own or possess a firearm without discrimination. I signed this legislation into law because I believe it is constitutional and I will continue to defend it.
Doctor: “Any guns in the house?”
Me: “Are you MY doctor or Obama’s snoop? Say, doctors kill more people than guns every year, so how many people have you killed lately? You’re fired.”
First off, my doctor hates 0 bummercare and I doubt she will ask. If I ever have a doctor ask, I’ll say “Yes”.
A paint gun, two staple guns, two caulking guns, a nail gun, several air guns, and two antique, single shot 12 gage shotguns.
I’ll also tell him / her that I need a volunteer to pull the trigger on the two shotguns since they are both over 75 years old.
Poll to freep
Based on recommendations from a task force led by Vice President Joe Biden, President Barack Obama Wednesday announced a program to cub gun violence through universal background checks and bans on assault weapons and high-capacity ammunition magazines. The president also issued 23 executive orders on the subject. Do you agree with the steps the president has taken?

Doctors and other health care providers also need to be able to ask about firearms in their patients homes and safe storage of those firearms, especially if their patients show signs of certain mental illnesses or if they have a young child or mentally ill family member at home. Some have incorrectly claimed that language in the Affordable Care Act prohibits doctors from asking their patients about guns and gun safety. Medical groups also continue to fight against state laws attempting to ban doctors from asking these questions.
The Administration will issue guidance clarifying that the Affordable Care Act does not prohibit or otherwise regulate communication between doctors and patients, including about firearms.

Urgent: Should Obamacare Be Repealed? Vote Here Now!
I have been told by a neighbor that a patient who lies to his doctor, under obumbler care regulations, will commit a federal crime and lose his CCW....because they plan to cross check names with CCW lists.
Does anyone know whether this is factual?
Does anyone have a link?
Well, the ones I have are locked up and neither of us has a mental condition.
Here in California they already ask us about it.
I’ll say just one thing on this: Competent lying is a survival skill.
I’d ask the doc....Do you want to know about the hammers, knives and buckets I own also? They kill more people than guns, ya know....
“Declined to answer” isn’t a lie.
I think Doctors starting today should bombard their liberal patients only with personal questions on and on saying all along that this is part of the New Obama care that they voted for. If the people who voted for Obama/ liberals feel that the personal questions the doctor is asking as in reference to owing a gun, their sanity/ mental health, their family memberss mental health, what he financial situation, stress level etc. is like in their home, whether they are recieving gov. assistance, etc. causing mental stress and financial problems, etc. in the home, you see where I’m coming from and going with these questions, all directed to liberal patients. If the doctor suspects the patient is conservative Hi-Five him and ask no further questions. Treat the conservative patient differently from the liberal. Turn the laws against these bastards!
I work in Oakland,Ca, one of the most crime ridden, gun toting, gang banging cities around.
I just happened to notice the question when reading some of the intakes. Not all Drs ask, or if they do, it is not transcribed in the chart.
Let me tell y.ou what your smart mouth and empty threats toward a medical personnel is going to get you--a call to the hospital security.
Then you'll have a very big problem on your medical record.
Doctors were at the forefront of the tea party.
