George Will, DOMA, and Polygamy

Dr. George Will is a respected social scientist and acclaimed writer, but he’s not a lawyer. And he shows it by suggesting the Defense of Marriage Act (DOMA) is unconstitutional as the Supreme Court prepares to hear a challenge to that federal statute this week in U.S. v. Windsor.

DOMA prevents the federal government from giving federal marital benefits to gay marriages or polygamous marriages, and the Constitution allows Congress to make that judgment.

Will has made valuable contributions to the issue of gay marriage. And on a personal note, I’m grateful for Will’s very positive Washington Post column last week on the Supreme Court legal brief that Prof. Nelson Lund and I authored on behalf of nationally-renowned social scientists and filed in the marriage litigation.

Our brief explains how there is currently no social science supporting the conclusions of liberal interest groups like the American Psychiatric Association when they support gay marriage. “Back off, man, I’m a scientist,” might have been a great line for Bill Murray in Ghostbusters, but it’s a lousy way to interpret the Constitution and make federal laws.

In our constitutional system, states define marriage. But that means states determine issues such as how old you must be to get married if you are not yet an adult, or which relatives (e.g., brothers and sisters, first cousins, second cousins) are considered too close to be married without committing incest. Until recently, all those laws required two persons, one man and one woman.....

I could not careless about what crap the elitist, liberals communists or others state or not say, I will never accept feces sex as a step to marriage and then have children be adopted by these people to then tell me they;re a fmaily and then have it taught in the schools like fisting

If marriage is no longer : one man and one woman , then we can avoid inheritance taxes by marrying our children.

Look at what the APA is considering now.

Several well-known researchers recently made unexpected arguments on pedophilia at an academic conference in Baltimore.

Liberty Counsel Action’s Matt Barber attended the conference and says he felt he was on a different planet, as the presenting professionals aimed to remove pedophilia from the American Psychiatric Association’s (APA) Diagnostic and Statistical Manual of Mental Disorders (DSM). That would mean that pedophilia would no longer be considered a mental disorder.

“The entire focus of the event was on the victimhood of the pedophile,” Barber accounts. There was “very little concern for the children who are the victims of these individuals when they are raped, who these individuals lust after,” he adds.

And he says the experts’ discussions were focused on “destigmatizing pedophilia ... removing the stigma, and [getting] the public to stop demonizing pedophiles.”

But the attorney reports that the APA is already moving toward declassifying pedophilia as a mental disorder “by saying that a pedophile is only a pedophile in their latest DSM ... if they are distressed by their attractions or behaviors.”

So Barber decides that would bring the APA one step closer to de-classifying pedophilia as a mental disorder, as they did homosexuality in the 1970s.

George Will seems to be confused over the difference between a “bad law” and an unconstitutional law. There is nothing unconstitutional about DOMA. Gay unions are not identical to heterosexual unions and the government routinely differeniates based on different forms of sexual behavior in the application of law. The problem is that even many so called conservatives have gone limp noodle on this. Its one reason why this issue is far more dangerous than it seems. The idea that expediancy of the desire to overturn a law that some dislike or think is unwieldy is enough reason to declare it unconstitional is just another indicator of judicial decline. The reasons for DOMA was to prevent exactly the things we are seeing any place SSM takes hold which is a suppression of religious and personal liberty of anyone who simply disagrees with any element of homosexual activism. The law which I believe is imperfect and would’ve been better had it been a more general augmentation/protection of religious and personal liberty and association is proving to have been necessary at least in intent. If SSM is so inevitable then Congress can simply repeal DOMA a law which was entirely bipartisan.

The leftists on the Court will simply apply heightened scrutiny and rule that any classification that treats gay couples differently than married heterosexual couples is invidious. They care not about the law, but about power and results. They are evil, immoral and depraved. We the people need not give any credence to an unconstitutional ruling from the Supremes. Nullification will rule the day.

I don't see how DOMA could be unconstitutional, any homosexual may enter into Marriage with someone of the opposite sex. They choose not to, there by expressing their individual freedom to choose.

The point of law that advances homosexual ‘marriage’ is to force the citizens into supporting and servicing homosexual behavior.

The govt does not belong in the affairs of marriage.

homosexuals have the very same rights as us and I hope our side pointed this out to the court.

We cannot marry the same sex and they cannot marry the same sex.
We cna marry the opposite sex and they can marry the opposite sex

No rights have been taken away and we have exactly the same right

When the democrats decided to remove God or any reference to Our Creator at their 2012 convention. They also demonstrated they are no longer the democratic party of your father’s father. They have become a hyphenated radical unit and should be known as Demo-Coms dedicated to the establishment of a collective idealism using the device of PCP to modify behavior and shed beliefs that they believe would impede remaking their concept of the perfect utopian state. That is hardly democratic because the word democrat idealizes the individual voice.

But Rove, GOPES (GOP Elite Snobs) and RINOS lack the capacity or the understanding or the courage to point to the historic radicalization that occured at that moment and use it politically. Worse yet they are unable to forthrightly defend what the demo-coms have set out to destroy and some are even comming up with their own version of PCP . Anyone preaching PCP is going down the poisonous road to oblivion . Following a policy of PCP. Politically Correct Politics which the hyphenated democrat party, the Demo-Coms,is using is flat out wrong.Worse yet moral questions such as marriage, sexual practices, family constituency and particularly beliefs those of containing Judeo Christian tenets are being assulted and not defended. That offers a majority of voters no choice in the direction this country is to take.

PCP when used by the Demo-Coms such terms as: Afro-American, Hispanic-American, Asian-American, White-American, Rich-American ,Gay-American, are more than simply nouns but vehicles used to separate US from each other. Beside separating US from our money the Demo-Coms demand we become adhearents to a system without the constituional constraints on government. Thus surrendering our protections from governmental abuses and excessive bureacracy to the will of a bureaucratic collective which is no longer answerable to the average citizen.

Sadly for the Republicans God remains in Limbo

I think when our back is to the wall and we are left without any hope, God steps in, so their is no doubt that it is Him who is working, not us. That is IF His people who are called by His Name, humble themselves and pray, and seek His will face, and turn from our wicked ways; then He will hear from heaven, and will forgive our sins and heal our land.
