Governor Dayton and the Bureau of Mediation Services yesterday settled to reimburse $60,000 in attorneys fees to the home-based child care providers who sued to halt Governor Daytons unlawful executive order establishing a unionization procedure for the providers. In Swanson, et al. v. Dayton, et al, the court found that the governors executive order exceeded his constitutional authority, struck down the order and awarded attorneys fees to the prevailing plaintiffs. The Administration paid these fees in compliance with a Minnesota Court of Appeals order earlier this year which said the fees were owed because the Governor was not merely wrong in issuing this unionization order, but had no substantial legal justification to do so at all under Minnesotas Constitution and laws.
The Minnesota Equal Access to Justice Act requires an attorneys fee award to small business prevailing parties if they are forced to legally contest governmental action taken without substantial legal justification.

Governor Goofy loses again.
Governor Goofy needs to pay these charges out of his won pocket instead of the taxpayers paying for his incompetence.
The Mob feels empowered with Obama in charge.
They actually believe they can simply tell small biz owners they are obligated to pay mob protection money.
Good progress is being made against state-sponsored union mob shakedowns. The cumulative effect will eventually distroy the whole collective.
One for the good guys.
On the one hand, I agree ... but on the other hand, the people elected him. If voters don't feel the pain when they elect crooks, union shills, or fools, they'll have no motivation to make better choices.
The people that voted for Crazy Eyes Dayton are too ignorant to even realize they are paying for it. There will be no motivation to change their ways. As long as ‘it’ has a D after it’s name, they’ll vote for it.
Sad state of affairs, especially to those of us that pay attention.
That’s a good point.
Thanks. It’s just so frustrating, as a conservative, to live in a deep blue state.
With all the illegals in this state being allowed to vote by democrat election judges who look the other way, every democrat candidate starts out with 300,000 votes on their side of the ledger.
And the democrats know it because they fight tooth and nail to keep Voter ID from becoming law.
It’s frustrating to live in any state ... except perhaps Oklahoma, but you do have it harder than most. Being cold, too!
Can we stop with this RED/BLUE indication of conservative/libtard?
Before AlGore ran ALL conservatives/GOP were always blue and the dems were COMMIE RED
We need to go back to that- I hate being called RED - remember the phrase “better dead than red” ? That’s the only phrase I have not yet heard them adopt for their own, but it is coming...
This is ANOTHER instance of the commie/libtards perverting the language against us (and us letting them define terms, again)
We need to recruit some Tea Party Democrats to start running
against the libdems in the primary.
Wouldn’t liberal in name only be great
to start seeing?
That’s a waste of time and effort.
New polls out in MN, Frankenberry and Dayton each lead their various 2nd tier challengers by only about 10 points.
The media’s red/blue switch was done long before the 2000 election. I believe that it was done in the 80s but I’m not certain of that.
All we need to defeat Franken is a first-tier candidate; the rest will take care of itself. The best guys would be Governor Tim Pawlenty or Congressman Erik Paulsen, but unfortunately both have passed on the race.
That’s actually a pretty good margin for Minnesota. Remember the disaster that Bills was in 2012? Though Klobuchar is much more popular than Franken (not sure why, she’ a dunce).
So far, the only candidates that might be acceptable in the race are people from the legislature, Ortman and Abeler. The other guy is a Charlie Crist type.
I wish T-Paw would have run. In a good off-year, he’d have beaten Franken.
when a leftist is offended they want millions and a change of the law.
How come “our” side barely gets the legal fees paid for?
Well she's not HIM,, so there's that. The guy is a freaking (unfunny) joke, I can still hardly believe he's a Senator (thanks to Ventura's stupid party).
There was no consistency prior to 2000. No one cared much about election maps coloring or election maps for that matter.
But I fully agree (see my tagline) that the media colors are very inappropriate, and that’s what they want, to not have the democrats associated with international color of socialism and communism.
no, it was for Al Gore
I vividly remember wondering why they were coloring democraps blue
