On the evening of November 30, 2013 Joey Posey, a veteran of the Army’s 101st Airborne was arrested and jailed by police in Andrews, TX. He had taken a walk with his children to get ice cream and french fries and decided to openly carry his AR-15 in addition to his legally concealed handgun. Although the open carry of a longarm is legal in Texas, it was for this reason that he and his children found themselves forced to the ground as soon as the police arrived on the scene. For two months now SPC Posey has been in legal limbo. There have been no charges filed yet, his weapons have not been returned and his concealed-carry license has been suspended. What Joey didn’t know when he left his house that night was that he was not the first person whose firearms rights have been suppressed in Andrews.

To show support for Joey Come and Take It Midland/Odessa organized an open carry walk in Andrews in the weeks after Joey’s arrest. As the walk was coming to an end, Andrews police approached the group of demonstrators telling them that if they did not disperse they would be in violation of a municipal code that pertains to motor vehicle operation.

Following that incident, three members of Come and Take It Texas met with Andrews, TX Police Chief Bud Jones to ensure that the rights of Texans would no longer be suppressed by his department and to get permits signed for their upcoming demonstrations in Andrews. In that meeting the Chief assured them that and understanding had been reached. He gave his word that he would do everything in his power to protect the legal rights of gun owners in the future.

At one time, when a Texan made a promise and shook your hand, you could rest assured that he would keep his word. Unfortunately, Chief Bud Jones failed to keep his word, and he failed to honor the oath that he swore to the Constitution.

On January 22nd, 2014 former Army Sergeant Michael Keoughan, one of the CATI members that met with Chief Jones, went to Andrews to survey the approved route for their next open carry walk. Given the multiple reports that Andrews PD had used intimidation to ‘convince’ people not to open carry in Andrews, Michael also wanted to film himself open carrying that day and prove to the members of the the new CATI chapter in Andrews that they no longer needed to fear their police department. Sadly, Michael was illegally arrested that day, and his weapons were unlawfully confiscated. CATI recorded their meeting with the Chief, and have posted some of that interview on their YouTube channel but the local media refuses to address this part of the story. It seems the ‘good ol’ boy’ system is still alive and well in West Texas.

As if this story wasn’t bad enough;

When a local news station posted a story on their Facebook page about Keoughan’s arrest and the upcoming CATI demonstration to be held in Andrews, a resident of that town made threats against the group in the comments section of the post.

Two of CATI’s members were so concerned by the threats that they contacted Andrews PD to file a report in case the man did make good on his threats. One of the members, an over-the-road trucker, was told that a report would not be taken. The officer went on to inform the caller that the town was full of “rednecks” that would likely shoot members of CATI and that the victims could expect that the person would never be found or brought to justice. After that the officer hung up and did not answer again.

A Sheriff’s Deputy was recorded as he made a similar comment to CATI members while they were waiting for Keoughan to be released from Andrews County Jail. 
 

Another CATI member was told that a report could not be made over the phone but, if she would make the seventy mile drive to Andrews, that a report could be made in person. She immediately drove to Andrews only to find that the entire police department was too busy “in a meeting” to speak with her. A Texas Ranger stationed in Andrews made it clear that no one was going to take a report, calling the posts a “perceived threat”.

Local media has ignored these two cases of dereliction of duty, just as they have refused to report the facts showing that both of these veterans have been victims of Official Oppression

Perry can't do much as governor, and that's by design.

Abbott is the one that needs to address this, since he's the AG.

And Dewhurst needs to address it in the legislature, but I won't hold my breath on Dew-worst.

There are a lot of statists in high places. There are a lot of people who have been lied to by the old media. There are a fair number that are waking up and trying to wake up the rest. We are winning in Texas, but it is not a sure thing, and good Texans can use all the support they can get.

Wow, sounds like Austin, not west Texas. When I lived in the Panhandle, I would never have thought something like this could occur in that part of the world.

Sounds like an Athens, TN action might be appropriate here in the near future.

It's legal to carry a rifle or shotgun openly in Texas. What isn't legal is for law enforcement to 'discourage' people from freely performing lawful acts.

I smell typical cops. They don’t care about parties. In fact, I doubt the majority even vote. And if they do, they don’t know what they’re voting for. Believe me, I grew up with cops in the family. The ones I knew were dumb as hell.

What needs to be done in this situation is people need to get elected to the city council and fire the chief. And make sure his replacement knows the constitution and intends to explain it to his cops.

I got arrested for three trumped up charges-Fail to carry ID (I was on foot demonstrating Abbott’s SILENCE on immigration), Disobey officer (I refused to sit on the ground as COMMANDED) & a jaywalk. all of these dismissed. I had to get an ACLU attorney to represent me on this false arrest at the hands of a METRO officer. We await their response. Conservative judges apparently gave us the Ruling in Atwater (TX CASE) where a mother and her kids were not wearing seatbelts. She gets taken to jail. As a result of conservative ruling in this SCOTUS case cops can now arrest for throwing bubblegum out of a car window. it was a BAD THING!

Texas has always had it's share of corrupt law enforcement. These days, though, like you see on this thread, there is an organized effort to contact the AG about it. This problem will get sorted out. Gregg Abbott is pro open carry, and doesn't put up with BS by law enforcement.

When the Feds were doing the stop and swab roadblock in Ft. Worth, the FWPD chief got whacked pretty hard and publicly apologized for allowing his personnel to get involved with that.

Lots of Texas Freepers sent emails and sent phone calls over that issue, too.

So? What he was doing was perfectly legal. One hundred percent legal. Who gives a crap how many people called the police? That's a separate thing.

The cops' job is to uphold the law. The cops' actions were in direct violation of the law.

I’m not sure I want to go to the shoot if the cops are going to steal our guns from us. We have some VERY expensive pieces, and replacing them would cost us a pretty penny.

That would be the definition of "conservative" that means "to protect from harm or decay." These judges are all for using law enforcement to protect "immoral" people from harming or decaying themselves.

Not to be confused with the definition of "conservative" that means "to use sparingly." THIS variety of conservative judge would have ruled in favor of limiting the reach of government, hence a mom whose kids weren't wearing seatbelts would be, horror of horrors, left to run wild and propagate! Chaos would ensue as people, even children, went riding around in cars with no seatbelts. That's the kind of thing that happens when you use government sparingly, you know!!!!

It sure the hell was! It happened where I live.

O’Connor sealed it saying almost literally Well This Is Bad Law But The Consequences Of Turning It Over Would Cause Too Much Chaos for Law Enforcement Nationwide.

You won't be carrying openly, so don't have anything to worry about. This is one podunk town with a Sheriff who's too full of himself to know (or care) how the open carry law works in this state. He'll soon be straightened out.

Dewhurst is running again, and it doesn't matter, as long as he doesn't get 50%+1. Staples would be fine to be in a run off against him. I thought Patterson would be, but Patterson has been less than responsive to some questions.
