Lessons Learned and Lessons Missed from the Attempted Land Grab

We learned that the government will do anything to private citizens in order to grab land and private property either under the guise of protecting an “endangered” desert tortoise that is actually overpopulated, or getting rid of “feral” and destructive “trespassing cattle” grazing the land for generations, cattle that are in the way of developing a $5 billion Chinese solar panel plant (ENN), and the exploitation of rare earth elements in the larger adjacent area.

Mr. Bundy was too stubborn, the last rancher standing in Clarke County, Nevada, clinging to his inconvenient “feral” cattle, his agreement with the State of Nevada, with the Bureau of Land Management, BLM, his “prescriptive rights,” and his ranch. I thought cattle were domesticated, not feral, and were raised for beef consumption.

Mr. Bundy may or may not owe the $1 million in grazing fees. The case is not clear-cut on either side and may go all the way to the Supreme Court. If someone trespasses or uses someone else’s land for at least five years without the owner of the land taking legal action, that person can claim prescriptive rights. In Mr. Bundy’s case, twenty years have lapsed since payment of fees have been in question.

Dr. Paugh lays out another take on the actions of big gov vs. "domestic terrorists" in NV. I kinda had the same thoughts about the absence of any animal "rights" activists in this little dust up. Why were the cattle allowed to be "bullied" and why were the feds allowed to be "bossy" when it came to the treatment of the cattle? Where's peta? I surely can't claim to know everything about the whole mess.

Isn’t it amazing the BLM will use its storm troopers against American citizens, and will do nothing against illegal invaders at out southern borders?

If someone trespasses or uses someone else’s land for at least five years without the owner of the land taking legal action, that person can claim prescriptive rights.

This legal doctrine is known as adverse possession. The length of time varies from one jurisdiction to another. For example, in Texas it's 20 years.

I don't think I would use the word "trespass" in the petition for title.

A question I have concerning “the federal marksmen” (I remember that Asian yackoff from Ruby Ridge very well).

In this day and time, how many of “the federal marksmen”, were possibly in the sights of an Iraqi/Afghani-returned milvet true American, who possibly had possession of a nice-looking Barrett rifle, from somewhere further out, other than ‘in front as the majority of folks were photographed’?

A question, too, about how the water wells were damaged, intentionally, by the BLM thugs.

When will there be restitution made for destruction of private property?

I agree with all the States in The Old West, with the proposition that under the 10th Amendment, they seize all “federal lands”, which is an unConstitutional phrase, since the establishment of those States as such, is when they ceased to be known as “the Oklahoma territory”, “the New Mexico territory”, etc., but became sovereign States, with their own Constitutions.

Evidently the local authorities were either not adequately prepared or inclined to “kick them the hell off the land”.

SeeSharp’s point on the long standing legal doctrine of “adverse possession” seems to have overwhelming weight in the rancher’s favor re his rights to the land in question.

Yesterday Bundy reported that 37 cattle were missing, allowing that some may be in the bush. He also reported that they found a 30'x50'x10' trench dug by the BLM that was 1/3 filled. They haven't had the time yet, but they intend to dig up that 1/3 and see how many of the missing cattle are in there. He also reported there was a high mortality rate among the newborns due to the helo roundup. That's gonna impact next years income.

The County Sheriff has a TON of legal power within his jurisdiction and Federal Law says that ALL agencies must work through that office. All Gillespie had to do was order them off the land or be arrested. Wimpy Sandoval could have instructed him if he didn't act.

Unfortunately, the good Sheriff (of Nottingham) came from the ranks of The Southern Poverty Law Center (ACLU on steroids) and is a lap dog of the Democrats.

Sheriff Mack said that Gillespie wrung his hands and said he was powerless - or words to that effect. Unfortunately Part II, Clark County, as is Nevada, is run by Las Vegas and nothing will be done to throw him out.
