How Massachusetts H.4121 Would Abolish The Second Amendment

This legislation is pretty scary. In Massachusetts you have to have either a License To Carry or a Firearms Identification Card to own a firearm.

The H.4121 legislation would make the issuance of both of those items totally discretionary. The police chief can deny your request and simply declare you "unsuitable" for any arbitrary reason.

If they can get this to pass, then plan on seeing the same approach attempted in other states.

This would be a clear violation of the Heller decision.

“...This would be a clear violation of...”

They don’t care.

If they think they can remotely get away with it, they will try it.

If the citizenry doesn’t push back - hard - they will get away with it.

CCW permits in CA are discretionary, but you don’t need a license to own a gun. Long guns and handguns do require registration. All firearms must be sold thru a dealer. CA is looking at permits to buy ammo.

With the 9th Circuit ruling in Peruta v. San Diego saying that the state must allow either concealed carry or open carry and the 7th circuit ruling in Moore V. Madigan that forced Illinois to adopt shall issue concealed carry, vs. the 3rd Circuit ruling in Drake v. Filko where "justifiable need" was upheld, the entire issue is eventually going to wind up in the Supreme Court.

Let the Massachusetts legislature pass this law which will also be challenged all the way to the Supremes.

Have been invited by my sister to move to California. Told her the chances of my doing that we’re about the same as Hell freezing over.

They can issue as many laws and regulations as they want to. Doesn’t mean I will obey them. Welcome to the NWO where every citizen unit is turned into a criminal to be exploited for profit at the king’s request.

“Whomever votes for this should be shot. This is what the second amendment is for.”

Dead right! Liberals and the NRA think it is about “the sporting purposes of firearms”.

I don’t want to break it to you, but this has been the case for years.

The local police chief “May” issue. It varies town to town. In the cities, you face a tougher battle. My town generally does not issue conceal carry, but I can own handguns.

I don’t agree with the “May” issue part of it. But that’s the way it is.

mass does not care. There is no penalty for knowingly passing laws which can not stand and they know it. In their eyes all laws are 100% legal until a judge forces they to tweak it.

Hard to believe that the laws in MASS used to REQUIRE people to carry guns while on a journey and to church. But that was back in the day when you could be murdered real fast.

OH WAIT! The only difference is that back then the murderers would also scalp you!
