I know EXACTLY why they voted for Brexit. The EU is trying to dictate to other countries what to do. They are out of control.

Red states would welcome blue state jobs. I guess it does not dawn on states like California that Idaho and Arizona would welcome employers who are disadvantaged competitively
by producing their product in California. Need not move to China. Just move next door to Arizona. Works for me.

Does the Logan Act apply? Who could give federal blessing to a private individual to negotiate with a foreign entity?

In a slightly different scenario, what is the legality of a city or locale negotiating with, for example a Chinese government entity, to establish a manufacturing facility?

I know, I should have gone to law school...

You’re right. Article I, Section 10 of the U.S. Constitution.

States Rights are a good thing all of a sudden. Maybe I will tell that to some Confederate statutes before they get ripped up.

"Executive Branch, however, as now they’ve decided to work
with US states and cities that are keen on cutting their
carbon footprint by going over the President’s weirdly coiffed head."

If an EU "representative" or an Euro nation "diplomat" or
organization tries that, then the "representatives" or "diplomats"
or organizations should be declared persona
non grata and tossed out of the country. If they persist,
shut down their embassies and break relations with them.

They can't, and furthermore, any official who enters into "negotiations" with a foreign power in an agreement expressly opposed to the policy of the US government will be committing a felony violation of the Logan Act.

I would love to see Governor Moonbeam frog marched into a Federal penitentiary.

States are not allowed to enter into alliances with foreign powers.

Nor are individual US citizens permitted to engage in negotiations or actions in contravention of US Federal Government policy.

No federal funds for these states! At the very least, slow walk the money.

I am so glad so many of us recognize the illegality of these contemplated actions. Now, if the DOJ will just act, we will hear of dozens of mayors, etc., frog marching to jail for engaging in negotiations and actions contrary of USFederal Government policy. I hope so.

Mike Flynn is accused of negotiating with Russia 4 weeks too early. That’s what all the Russia drama is about.

I guess its only an issue for republicans.

But -- as far as we know -- Flynn did not discuss any position clearly at variance with US government policy. For a state official to conduct negotiations in clear, self-admitted, opposition to US policy is a felony violation of the Logan Act, something that Flynn did not do.

Governor Moonbeam has got all the “reckless” anybody could want right between his own ears. Comes of never having to pay for anything himself.

...an agreement expressly opposed to the policy of the US government will be committing a felony violation of the Logan Act.

Since WHEN does the law mean anything to Democrats and other assorted fringe lunatic liberals?? Breaking it is a resume enhancer.

Hey EU ...wrong. Nice try, but we’re not a European union of nation-states we’re the UNITED States - and we don’t do ‘open borders’. Crack open a Constitution sometime, goofballs.

Is it unconstitutional for individual states to enter into formal agreements with foreign nations?
