Under any circumstances, this is not first degree murder, could be manslaughter, but the cop with no name will never be charged.
Cops are not trained to fire "warning shots" that went out with Hopalong Cassidy and Lash Larue.

When an unarmed person is shot from a distance making no attempt to harm the shooter, while wearing a backpack that the shooter could not even have seen, the shooter is pathetic.

There is a question as to whether the force he used was excessive, but he was plainly justified in using some force and I tend to give a guy defending his post during a riot the benefit of the doubt.
The bottom line is he is not the one who caused the situation. Babbitt and her idiot companions are. If anyone should be charged with her murder, it is her fellow rioters. Under some states’ laws, they would be guilty of her murder.
If only she was high on Drugs, then her Family might have gotten $27 Million for Wrongful Death.

She wasn’t shot from a distance. Have you seen the video? And whether she was trying to harm the shooter is irrelevant. Police officers are not limited to using force in self defense.
