DeSantis’s statement is very good and well thought out. He’s doing fine. There is an effort to drive a wedge between the two camps and it’s working better than it should. DeSantis adds to this by his “l’m running / l’m not running ambiguity. It is the smart move because he needs to see what’s there when the fog clears but it is feeding the friction we see here. It is how the sausage is made.

DeSantis is obligated to refuse to extradite a Citizen of Florida to this circus--in fact, to protect President Trump. If DeSantis fails to do so, he is DEFINITELY NOT Presidential material.

If a Florida grand jury ordered the arrest of Hillary Clinton there is zero chance anyone in New York would enforce that.

That’s the problem. We play by the rules. They don’t.

Typing in all caps doesn't change the legal reality.

The Extradition Clause, in Article IV, Section 2, of the United States Constitution reads:

"A Person charged in any State with Treason, Felony, or other Crime, who shall flee from Justice, and be found in another State, shall on demand of the executive Authority of the State from which he fled, be delivered up, to be removed to the State having Jurisdiction of the Crime."

18 USC 3182 reads:

"Whenever the executive authority of any State or Territory demands any person as a fugitive from justice, of the executive authority of any State, District, or Territory to which such person has fled, and produces a copy of an indictment found or an affidavit made before a magistrate of any State or Territory, charging the person demanded with having committed treason, felony, or other crime, certified as authentic by the governor or chief magistrate of the State or Territory from whence the person so charged has fled, the executive authority of the State, District, or Territory to which such person has fled shall cause him to be arrested and secured, and notify the executive authority making such demand, or the agent of such authority appointed to receive the fugitive, and shall cause the fugitive to be delivered to such agent when he shall appear. If no such agent appears within thirty days from the time of the arrest, the prisoner may be discharged."

In Puerto Rico v. Branstad, 483 U.S. 219 (1987), the Supreme Court, unanimously held that the Extradition Clause's commands are mandatory and afford no discretion to executive officers of the asylum State and that the federal courts can compel a governor to comply with the Constitution, if a governor tries to ignore the Constitutional command.

I understand that the Constitution may just be a piece of paper to you, but this legal issue has been settled.

Something to note:

Limitations was 5 years, on the outside. The alleged payment to Stormy Daniels was 7 years ago. So this case cannot be brought, even if somehow a felony.

Florida does not permit extradition for misdemeanors. It’s not clear what the charge will be. But DeSantis could tell NY to pound sand.

Regardless, DeSantis has the right under Florida law to investigate the merits of the charge and could deny (or just hold forever) the warrant.

Okay, let me address the elephant in the GOP tent head on.

While it's true that the Deep State is real, and they have (and will) pull every dirty trick available to block him from running again, Trump's hubris, and lack of discipline have given them most of the proverbial rope they are hanging him with.

How could he not know that his inability to "mingle" with a porn star wouldn't be used against him, irregardless of how unfair it is ?

Stepping on the Deepstate's toes puts trillions of dollars they are grifting at risk.

Trump more than anyone should know what these people are capable of, you can't build a fortune in NYC without knowing how to deal with these people and what they will do when you turn on them.

I'm sorry, but I have not seen the political growth needed in Trump to beat these guys a second time after they were blindsided by their hubris.

Trump reminds me more and more of Sarah Palin, another disappointment who didn't make the necessary adjustments to match the current political realities.

I am NOT saying this out of a dislike of Trump as individual, but out of desperation to save our Nation as founded.

Unfortunately I think the election will be the last opportunity to peacefully attempt to correct the destructive path we are heading toward.

It’s been explained here many times that he doesn’t have the authority to deny extradition. Besides, Trump’s lawyer already said that he’ll surrender peacefully.

That provision has been limited to FELONIES.

This is purportedly a misdemeanor, for which no extradition lies under Florida law (or the US constitution).

The Governor also has the right to investigate the merits, to a limited degree. Given the statute of limitations has clearly run on any possible crime, that would be grounds to deny extradition and possibly sanction the NY prosecutor for asking.

What I understand is the clock stops when the person is not residing in the state.
