I would further submit that, as the illegals could be considered an invading force, Biden’s actions are directly providing aid and support to an invading army, an enemy of the United States. Therefore, I would submit that it can be found that Biden has committed treason against the People of the United States.

I may depend on the writing of the legislation. The US Constitution gives the power of elections to the state legislature. That would not require the approval of the governor.
Other states have Republican legislatures and should follow suit. We need this tit for tat to start immediately to force SCOTUS to act before the primaries start.
