Florida residents/attorneys: File a RULE 1.290 DEPOSITIONS petition

The Florida Rules of Civil Procedure allow a deposition to be taken prior to a civil action actually being filed. Filing and serving this on Terri, and asking the court for an order inserting the tube so as allow the witness to live in order for the deposition, may be a last, best hope. It's clear Jeb isn't going to do anything.

You'll have to come up with a cause of action.

I don't expect this to work, but see if you can find a judge in some other county that will grant it.

I have a desparate last ditch idea that perhaps could blow Judge Greer out of the water and give Terri a chance. Greer has physically prevented people from giving Terri water. It seems to me that all he could legally do is order her feeding tube withdrawn. How can he legally stop her from trying to hydrate herself with her family's help? If she could eat and drink on her own can he order people not to give her food or water? Can he have this authority legally? We don't know if she could take nourishment on her own and he is preventing her from even gettig a chance. Can this be legal?

If he (Greer) has overstepped his authority with this action (stopping people from giving her water by mouth) and violated Terri's civil rights could Jeb Bush get him thrown off the case and an emergency order to let her parents give her water or ice chips? That may give her enough hydration to get her to a new Florida court and a new trial and custody order. Greer has been the major problem all along.

If it were my child, I would go in with a video camera and health care workers.......invite volunteers to provide numbers. Storm the place, and hold Terri hostage while the tube is put back in place. If she is truly "alive", and the family believes this, they CANNOT stand by and wait any longer. Make the police stop them, do as liberals do when saving a redwood.

I've been wondering (since last Friday) whether some individuals would attempt a rescue mission.

I'm sure it's been considered and likely, the hospice area has been cased already.

Maybe these people don't think they can pull off a rescue.

You know what? I wouldn't send any threats to him because I value my freedom. But if some other nutjob feels compelled to do so, I hope they're very convincing. I like the thought of him cringing at every shadow and bump in the night for the rest of his putrid life. Same for Mikey. The democRATS can blame whomever they wish. The people who matter will know better.

I've been talking and praying to OUR FATHER none stop for days. At first franticly, but then I asked him to calm me down and accept his will and he did.

rather, acknowledge the one that does exist and uphold the Constitution, not the "rule" [of law] of a county PROBATE judge in FL.

This cannot be allowed to stand! It took the US Supreme Court to legislate abortion from the bench -- now it takes A COUNTY PROBATE JUDGE to create THE LAW OF THE LAND which the GOVERNOR, CONGRESS, AND POTUS ARE SUPPOSED TO DEFER TO IN A MATTER OF THE LIFE OF AN INNOCENT PERSON?

Uh, yes there is.

He can call out the troops.

He can go in there, statute's say so: If they believe she's in danger from her guardian or if they believe (didn't say had to prove prior to doing it - unless I completely misread it on another thread) he's caused her to be in the harmful/dangerous condition or is putting her in harmful/dangerous condition. THEN face greer.

But there's gonna be a high cost.

Biggest problem: Getting her out in one piece, without someone of questionable character killing her in the process.

But can he order this? What is his legal authority? Can a judge just decide a person shall not be fed even by mouth? It has just been assumed he can make this order but what if he can't? If he has overstepped his judicial authority, and I cannot see how this order can have any legal justification beyond his mere fiat, then it seems to me that he has disqualified himself from this case.

It is not, repeat not lawlessness.

If, in the process of DCF doing it's assigned duties, the Gov feels they themselves are in danger, he can get back-up.

That would be like saying if bad people came to my house and had me hostage, my gov couldn't authorize protection for the negotiator, who, I hope like fury would be packin' to get me away from the cretins.

Rick Santorum was just on Hannity. He claims that Jeb is afraid to start a war between the Governors office and the maniac judge. If that's the case Jeb needs to get a little tougher IMHO.

That's simply not true! He, more than anyone else in Florida, is ultimately responsible for upholding the laws of the State. And there are laws that are being violated in this case. He is as complicit in this murder as Pilate was in the crucifiction of Jesus. I'm tired of elected officials, even Pres. Bush, saying there is nothing left to do. They have the Constitution behind them. It is criminal. Is there no one that will uphold the principles of life anymore? Look at all the people that are allowing this to happen, police, legislatures, judges, executive officers, DCFS, lawyers. These are the people that we rely on to keep our system running as it was intended. Guess what? I think that this country is headed for chaos, and soon, because those that are supposed to govern and protect are not doing their job anymore. I think it is something like, protect the guilty and punish the innocent.

you obviously don't care whether this "husband" of hers has been trying to murder her for 15 YEARS

He has gone through legal channels the entire time. Michael Schiavo has never tried to murder his wife.

there is a big stinking pile of evidence, including affidavits, that judge george greer has been sitting on for years and suppressing. why specifically - i don't know

He excluded some evidence from trial. That's perfectly normal.

maybe he's getting paid off.

That is just baseless libel.

but the evidence is there and it's more than enough to warrant removal of michael schiavo as guardian - hell i think he should be under arrest at this point!!!!

Something like 20 courts have reviewed this case and have fiund that Michael is the appropriate guardian here.
