In an exclusive interview tonight, Trudy Capone, a Florida nurse who spent over two years caring for Terri, revealed to Greta Van Susteren that Michael didn't know what Terri's wishes were.
Chacterizing her relationship with Michael, as a "confidante", she claims that Michael told her many times that he didn't know what to do with Terri because they had never discussed such things. Pressed by Greta to be more specific, Terri's former nurse said that Michael specifically mentioned that the subject of dying, death, and feeding tubes had never been discussed, and that he had told her that, often with tears, on many occasions.
Trudy Capone quoted Michael as saying "What do I do? What do I do with her?
In another confirmation of reports coming out of Pinellas Park, Ms. Capone said that when she was first assigned to Terri's care, she had been told that Terri was in a coma. Emphasizing her thirty two years experience in nursing, Trudy Capone said that upon seeing Terri she knew that certainly wasn't an accurate description of her condition. Saying, "Terri is not in a coma", she described how Terri would follow her with her eyes, respond to stimulation, cry at times and smiled often, especially when she saw a favorite caregiver or her mother and family members.
Ms. Capone described Terri as "animated" and in a remark that certainly contradicts what Michael and others have said, stated that "Terri is there".
Judge Greer won't care.
This whole thing is a very dangerous step in the wrong direction. I doubt much can be done to save Terri Schaivo, but I will bet there will be some serious attention paid to this issue, and legislation passed after the State of Florida is done executing Terri Schiavo
Yawn..killer greer will just ignore her..everyone is a liar..adulterous husbands are always honest..
Unfortunately I have a feeling that the damage done by 8 days of starvation and dehydration is too great for her to recover from even if there were some kind of legal miracle. All we will be able to do is make sure she didn't die in vain.
The culture of death will seek their next victim and we've got to meet them head on.
Making this all the more painful to watch. Such a tragedy.
My wife said to me tonight that she doubts this judge would be so dead set on seeing this starvation death sentence through if Michael was the one in the Hospice instead of Terri, I must say that I agree with my wife on this one

How many women (and men) are we up to now saying alternately that MS is a liar, didn't take care of TS at various points, didn't know TS desires, etc. etc.

I heard tonight that Greer was upset that he hadn't been told that TS had been communicative before - OH REALLY???
AND that the Schindler's lawyer asked for a new judge - Judge Grim Reaper Greer turned it down.

I've commented little about this here on FR because I didn't want to let my emotions overshadow my best judgment, but I am convinced that what is going on here would have our founding fathers shouldering a long rifle and looking to shed some blood of the tree of liberty over this travesty of justice

Don't misunderstand me, but the judge has a point. Why was this info not given to him - as in entered into evidence before the court - before now. It is a valid legal point.
And so this brings us to Trudy Capone. Where has she been all this time????? Did she volunteer this info to the court at any time, or to Terri's defense? If not, why not? These are valid questions. This type of information may have forced Judge Greer to have ruled differently duing the initial case.
Has Trudy brought this information to his attention at this point? Telling Greta on TV doesn't help. It has to be brought forward to the court if it is to be of benefit to Terri's cause.

Considering that Greer was at one point guardian for Terri, this shows he was derelict in his duty ... but course, we already knew that.
Clear and convincing evidence my arse Judge Greer.
Even Micheal's sworn testimony in the malpractice suite disputes that she wanted to die.
Oh wait..yes Micheal's relatives confirmed his 2nd version of her "wishes". Well that there couldn't possibly be a conflict of interest could it judge. (sarcasm)
There have been other women who have said essentially the same thing - Capone is not the first, and will probably not be the last.
The other women submitted affidavits - evidently Judge Grim Reaper found them not credible. Does this mean they don't go into evidence? (I really don't know)

This was substantiated by a friend of the Schindlers on Hannity and Colmes this evening.
This is all very well, but WHY OH WHY OH WHY these revelations are coming out at this LATE date? When the nutrition has been gone so long? SO MANY people coming out with revelations at the last minute!!! It COULD HAVE HELPED if they'd only GONE PUBLIC SOONER!!!!
Sorry for the all caps, but I am so heartbroken with this case, and I am losing all hope. I am losing sleep, I can't drink anything without thinking of that poor girl thirsting and starving to death. Dear God!
Why do you ask Jeb Bush to break the laws, instead of asking a Judge, *any* Judge ... to SIMPLY UPHOLD THE LAW ie protect Terri's 14th Amendment due process rights?

I agree. However, Terri is not a criminal... resting comfortably in a jail cell... with three squares and liquids... lounging along day after week after month while the tyrannical judicial problem gets slowly ironed out.

A case for Criminal Investigation of Michael Schiavo:
1) Nurses' testimony: Heidi Law, Carla Sauer-Iyer, Carolyn Johnson have been ignored and dismissed without hearing; each testified that Michael was abusive to Terri and may have attempted to kill her by insulin injection and attempts to induce pneumonia by turning the thermostat in her room to 64 degrees.
2) Michael Baden, top forensic pathologist in country and interviewed on Fox News National Television broadcast October 25, 2003 on Terri's bone scan and injuries states that:
a) Terri's injuries are not consistent with a heart attack; no cardiac evidence to support it
b) Extremely rare for potassium imbalance on woman her age and in her good health
c) Injuries are consistent with severe trauma possibly caused by a beating
d) The injuries in medical records warrant an immediate investigation
3) Dr. William Hammesfahr, Nobel prize nominee and neurologist testified that Terri's neck injuries are consistent with only one type of injury: that of strangulation.
4) Terri's doctor, Dr. Gambone resigned; he had previously testified Terri would die within a few days of starvation/dehydration. Terri has an obvious will to live.
5) Michael has enlisted the services of a new doctor, Stanton Tripodis, who has 5 malpractice suits against him. Clearly, Michael is attempting to provide sub-standard care for his wife.

6) Michael is committing adultery by living with another woman who has already born one child with another on the way, thereby creating an obvious conflict of interest as guardian.
7) Michael has committed both perjury (2 counts) and insurance fraud by promising to provide care and therapy for his wife in exchange for the court award of 1.2 million dollars in 1993. No care has ever been provided to Terri.
8) Michael Schiavo has also prevented Terri from undergoing a barium swallow test, a procedure necessary to ascertain the consistency of foods able to be taken by mouth.
9) Co-conspirator George J. Felos combined and conspired with Michael Schiavo to arrange for Terri's "free" stay at Hospice Woodside as part of an "exit protocol" designed to advance Felos' self-perceived messianic mission of "helping" incapacitated people to die by categorizing them as "terminal," warehousing them, and depriving them of therapy and rehabilitation services. (Attorney Felos is Director of Florida Right to Die and has testified that he can ascertain a person's desire to die by "looking into their eyes and letting their spirit speak directly to him")
10) Investigate Insurance company established in Jan 2001 at the home of Michael Schiavo and his girlfriend/fiancee Jody Centonze. (Jerger and Centonze Insurnace Agency Inc.) Michael is listed on the Board of Directors for the corporation. Note: Insurance is deliberately misspelled in the State of Florida Corporate filing, possibly to avoid investigation.

I am angry at the judge, but I am also beginning to wonder about Schindler's lawyers. If the evidence is this great, why cant they even get injunctive relief for an appellate hearing ?
