LOS ANGELES - Actor Chris Penn, brother of Sean Penn, was found dead Tuesday at his condominium near the beach in Santa Monica, police said.
Police said they discovered the 40-year-old actor's body around 4 p.m. Lt. Frank Fabrega said there were no obvious signs of foul play.
Sean Penn's publicist, Mara Buxbaum, issued a statement saying that "the Penn family would appreciate the media's respect of their privacy during this difficult time."
Chris Penn's body was found inside the four-story condominium complex after police were called by someone from within the building, Fabrega said.
Penn's body was discovered in a bed inside the residence, located in a four-story condominium complex near the beach on Ocean Avenue in Santa Monica, said Capt. Ed Winter of the county coroner's office. Authorities were called to the condominium complex by Penn's housekeeper, Winter said.
An autopsy will be conducted to determine the cause of death, authorities said.
Chris Penn's credits included "Mulholland Falls," "Rumble Fish," "All the Right Moves," "Footloose" and "Rush Hour." He also played Nice Guy Eddie Cabot in the 1992 Quentin Tarantino crime drama "Reservoir Dogs."
His late father, Leo Penn, directed television shows. His mother, Eileen Ryan, is an actress whose credits include "I Am Sam," "Magnolia" and "Parenthood." Another brother is musician Michael Penn.
Chris Penn's latest film, "The Darwin Awards," was scheduled to premiere Wednesday at the Sundance Film Festival.

He was wonderful as the klutzy sidekick of Kevin Bacon in "Footloose."
I'm more interested in Uncle Penn.
I'm... sure he will be missed?
You think that woman would have dated him if he were a McDonald's sidewalk sweeper???
By somebody anyway. Who was this guy again?
I didn't know he existed, until now.
Tell me again, why is this big news...?
Ha! I don't think any woman would have dated him if he had been anything other than Sean Penn's brother, esp. in Hollywood.
Boy, has he changed!
Maybe she's his sister. :)
Penn makes good reels...
That could turn out to be a classic irony.
I loved this guy! That's very sad. Probably a drug overdose.....
The news footage showed the police asking a neighbor about "his mood." Lends to possible suicide.
Which one was "Nicky Dimes?"
http://www.freerepublic.com/focus/f-news/1556083/posts. Here is what is killing his brother.
Never saw it.
My sympathies to Sean Penn and his other family members.
I liked him in the movies...this is too bad.
True Romance is one of my all time favorites, if not the.
Too bad it wasn't his traitorous brother.
Until now, I forgot he existed.
It's the same with all the Penns; they're so irrelevant
The Wild Life was excellent mindless 80's hoo-ha. "LES GIRLS"!
It's political payback.
A pretty busy character actor, did some narration for documentaries and video games also.
Always a reliable tough guy - sad.
what? no mention of the cheesy "best of the best" movies? no mention of him being the guy who chris tucker tried to blow up in "rush hour"?
and who can forget BEST OF THE BEST.
One's first thought is "drugs", but after seeing his picture I think it may be "heart attack".
I thought he was very good in "At Close Range".
God rest his soul and comfort the Penn family during this tragedy.
Favorite Bluegrass song!
He was great in that. I loved that movie...
Pale Rider. I was trying to remember the role where he was a cowboy.
The Penns are typical of the current state of Hollywood. Daddy had a job directing TV shows 40 years ago, so now we have to be saddled with the whole talentless family.
There was a time where the people who made it in show business were genuinely talented, extraordinary people. You paid to watch them because they made it worthwhile. But nowadays everybody is somebody's kid, or belongs to the same Kaballah ring or Scientology coven, and there is nothing extraordinary about them.
If I am going to look at a bunch of ordinary people, I'll deal with the people at my job, my neighborhood or my church. They're in Sense-Surrond 3D Hi-Rez Super-Wide-Screen format, and they're free!
I still don't recognize him, may he rest in peace.
Nicky Dimes was the light-haired cop that killed the bodyguard in the last shootout.
"I'll call you a hearse."
Normally I would agree but my best friend died at 36 from a blood clot to the lung. Natural causes can happen at young ages. But I agree with your sentiment that it is too young to die.
Normally true, but an exception is made for heavy smokers, several of which I knew that died very young. Add a weight problem and you've got a morbidly risky situation.
Chris Penn played any role given him very well. Funny and klutzy one minute. Vicious and mean the next. When his face was partially shadowed, Chris could be down right scary!
A Richard Widmark/Tommy Udo kind of tough guy.
I shall miss him.
Agreed. And my friend was neither overweight or a smoker. She just had a blood clot that went to her lung. It happens.
Hadn't seen him in a while.
He does not look well even in that photo.
The smoking & drinking are assumed considering where & how he lives (Hollywood, parties, etc.) Seeing how heavy he has become, diabetes enters as a real posibility. Hint, hint MEN, get a thorough physical early!
