Are there any lawyers on the site? If so, can the Paulus and Joran be forced to stay in the U.S. for depositions?

No. What the Holloways will get is a default judgment because the VdS will throw the suit away and go home.
And what do you think would happen even if they had depos? I mean, seriously....
To: Dark Skies
I'll be in great shape if this action by Kelly turns up anything for Natalee's family. If Kelly gets the chance to question Joran the right questions will finally be asked. I would think Kelly is ready for his lies and is prepared to ask the questions that will catch him in those lies.

They can just go home? Then what good was serving them? What do you think the purpose is?

Why couldn't they "just go home"? They are foreign citizens. You can't hold people here just because you sue them.
To: ContemptofCourt
Well I think the purpose is to finally have serious questions answered under oath. Call it leverage. If he slips up and tells too much the information can be used to find Natalee. Joran has given at leat 3 different stories about that night. Lying under oath here is a crime no matter where you come from. If he tells the truth it could help find her. If he lies under oath and is caught...well you know the rest.

When is he going to testify under oath? Never.
I notice that there is not a wrongful death count....that is interesting.

When is he going to testify under oath? Never.Well...that was kinda my quetion to begin with. Can he be held here until he is deposed? If not, you would be right. If so, this will get interesting.

Yeah, and I already told you that he can't. At the very least, they would have 20 days to respond to the complaint. No judge is going to force a foreign national to stay in the US to answer a civil lawsuit. Even if they got the VdS in court, they could just tell them to take the default and let them go home.
To: ContemptofCourt
I notice that there is not a wrongful death count....that is interesting.Sounds like the charges that are being made match some of the written statements that Beth was given in Aruba by the prosecutor. He never admitted to killing her, but he did claim to have sex with her while she was in and out of conscientiousness. That's a crime.

You have to realize that civil lawsuits are not about justice or any of that other happy horsecrap...they are about one thing...money. And a court will not impose any "criminal" type of sanctions on a party in a civil lawsuit.
Lets say that you got sued. The plaintiff wants to depose you. You refuse. They go to court. The court will compel you to be deposed. You again refuse. The court will impose a fine on you. You again refuse. At this point, the court will, at most, bar you from raising a defense.
To: truthluva
That's a crime.Where is that a crime? And has been charged with a crime?

Where is that a crime? And has been charged with a crime?According to Dompig it is a crime in Aruba. And...Dude...it's a crime here as well.
And we all know that he has not been charged with a crime. That's part of the problem.

Then why was he not prosecuted for it in Aruba? And I know that it is a crime here, but, in this case, so what?
To: OldFriend
Civil suit..It will be interesting to see what information they may give in depositions..or if they simply don't contest and stay out of our jurisdiction. They could not refuse to testify in a civil trial if it ever comes to that. I don't really know how this goes when it is not a resident of the US being sued.

Then why was he not prosecuted for it in Aruba? And I know that it is a crime here, but, in this case, so what? How closely have you followed this case? The 'why he has not been charged' has been speculated to death. Pick any of the possibilities you want. People can even think this guy is completely innocent of any wrongdoing if they want, but I don't see how any one could ask 'So what?'. He has admitted to committing a crime...sexual assault. Maybe in Aruba everyone thinks 'So what?'. Maybe some people in the U.S. think 'So what?'. hmm. See ya.

Oh boy - this is GOOD news. Great work John Q. Kelly. I still remember him questioning OJ Simpson on tape and he had Simpson so mad that he swore and had to take a break. He really pushed Simpsons buttons.
