Well then, who does the DNA belong to?

I don't think we should leave out the other "exotic dancer". After all she made the calls and drove the accuser to Kroger's--personally, I think she put her up to it since the girl was falling down drunk.

Could the alleged victim identify anyone in a line-up? If not, you are right - who are they going to charge?

who are they going to charge?

Two words: Tawana Brawley. I wonder if there would be such if it were a white girl and the Duke Basket Ball team.

I've been wondering whether what happened is, the hiring of the strippers was simply botched.

According to the reports, the lacrosse player Dan dealt with the escort agency and used the fake name Adam.

Maybe Dan was put in charge of the task of hiring the strippers, and instead of planning ahead, and taking the time several days prior to the party of actually going to a local strip club, checking out the strippers and arranging for two in particular to entertain at the party, Dan procrastinated.

He waited until too late, maybe even the afternoon of the party, and then desperately started calling around numbers out of a phone book. He found that the only place he could get someone to strip on such short notice were the two escort agencies, that it would be expensive ($800 plus tips), and then, when they actually showed up, Dan discovered he had hired older, overweight, drugged up african-american women.

Dan called the agency (Allure) that same afternoon and specfically requested white dancers. The team had a game in California on the 11th (incident was on the 13th) and had just gotten back into town. Not much time to plan ahead.

I have a few questions.

Where is "kim"? If the accuser was passed out on the lawn as the pictures purportedly show--who made the rape claim and when? Was it Kim, was it the boyfriend, or did the accuser sober up and suddenly remember?

Did Kim witness anything? Or did she wait outside for a half hour making 911 calls?

What was the alcohol level of the accuser? Could she ever be a reliable witness given her DUI's and rap sheet?

After the second 911 call to Kroger's did the accuser ask to be taken to the hospital? Was an ambulance called since she had so many cuts and bruises? Did the police send her off with the boyfriend? Wouldn't that be odd if she'd claimed rape right away?

From everything I've read, the time sequence relative to your questions is:

The two strippers start dancing sometime after midnight and stop dancing after only 3-4 minutes. According to the defense, they stopped dancing and went and locked themselves in the bathroom for 30 minutes. They then emerged and left the house and got into Kim's car.

The neighbor, who is watching the scene from next door, then overheard the accuser say, "I've got to go back in to get my shoes."

According to the defense, who claims to have a number of time-stamped photos supporting their account, she goes to the back door and bangs on the door but they don't let her in. They take pictures of her banging on the door with a big smile on her face, and she then falls down on the lawn, apparently sleeping or passed out.

According to the defense, the accuser was only passed out for a short time. One of the Duke students went out and helped her up, and there is a photo showing him helping her into Kim's car at 12:41.

The neighbor heard someone from the house shout "thank your grandpa for my nice cotton shirt" as they drove away.

At 12:55, Kim makes the first 911 call, complaining that a group of frat guys outside a house called her and her black girlfriend the n-word as they were (inconsistently) driving by/walking by/sitting in front of the house, and she gives the specific house address three times.

At 1:22, the security guard at Kroger calls 911 after Kim tells her a woman she picked up walking along the side of the road won't get out her car. The security guard notes the woman in the car appears intoxicated.

The police come. Within an hour, the designation of complaint is changed to a rape case, so it appears that it was when she was in the Kroger parking lot that the accuser told police she was raped. It is unknown if Kim was still around at this point, but it seems likely Kim left the scene as soon as she could. Apparently there are news reports saying that according to Kim, the accuser never told her she was raped.

At some point the boyfriend is called and comes to Kroger to get the accuser, and according to reports the boyfriend is the one who takes her to the hospital.

no sex (per DNA non-evidence) = no rape

One of the new lines now is that the negative DNA results were a direct result of a conflict of interest. The conspiracy is that the tests were done at Duke University Hospital and not at UNC Hospital in order to whitewash the results.
