Defense: DNA tests show no link to Duke lacrosse

RALEIGH, N.C. -- A second round of DNA testing in the Duke University lacrosse rape case came back with the same result as the first -- no conclusive match to any member of the team, defense attorneys said Friday.

Attorney Joseph Cheshire, who represents a team captain who has not been charged, said the tests showed genetic material from a "single male source" was found on a vaginal swab taken from the accuser, but that material did not match any of the players.

"In other words, it appears this woman had sex with a male," said Cheshire, who spoke at a news conference with other defense attorneys in the case. "It also appears with certainty it wasn't a Duke lacrosse player."

I don't know who will be sued, but I think this is going to be a major deal concerning the parents of every Duke Lacrosse team member. Defamation, false accusation, police misconduct, false arrest, and on and on...
It will be fun to watch.

who conducted the "lineup" where she was shown only photos of lacrosse players - and told "pick out who it was"?

that's not the way you operate a fair lineup, by including only persons from the pool of possible perps.

Yep; he's had this report at least two days and his office leaked it to the press, but couldn't find time to fax it to the defense team until 5:20 p.m. today.

The lineup; harassing witnesses with arrests for things people didn't do. Going to the dorm to talk to the players when they knew they had attorneys.

The cops were told to do it that way even after the cops told the DA that it was improper. IOW, the cops were POd at the DA and intentionally let Nifong screw it up.

The cops knew the kids were innocent and the screwup on the line-up made the ID of the two players inadmissable. The cops helped to prevent the prosecution of the players.

Believe me, I have no great love for most cops; but in this case, the cops did nothing wrong. Nifong ran all aspects of the investigation, and the cops let him screw it up by himself.

I've read all the articles posted on FR and there was at least one which stated the cops had told Nifong the lineup procedure was improper/unconstitutional. There have been several articles that indicated that the cops did not like the way Nifong took over the investigation.

IOW, their attitude was, "You want to run this investigation; go ahead, and we will sit back and watch you screw it up by yourself." You think the cops wanted to be associated with this Charlie Foxtrot?

I have a good memory and know how to connect the dots.

It was over when Reade produced an air-tight alibi but that didn't stop Nancy Grace's pretzel logic to convince us that facts lie. She and Whorealdo were besides themselves with glee when learning DNA appeared on the fake fingernail. Presser is on now on Nancy Grace. Can't wait to hear her spin this.

Well, since they already know who he is, his race is not a mystery.

The real question is whether the accuser admitted to having sex with him.

If she didn't there should be a lot of fallout, including prosecution of the accuser. False police report & all that.

I wonder if he was a boyfriend, her pimp, or a customer?

More likely someone who 'employed' her as an 'escort' earlier in the evening.

It would seem logical that in whatever interveiws she gave the Durham PD, someone would have asked if she had sex earlier in the evening and then that individual would have been contacted for a swab to elimanate his DNA as suspect.

The media continues to forget that this woman is a ho.

I saw the presser. Nifong's "Case" got blown clean out of the water IMO. He wanted this to be the case that made his career. Nifong is toast.

Not really. If there was the slightest bit of evidence of a crime having happened, the way was open to investigate, speculate and evaluate without fear of some sort of defamation suit down the road.

Otherwise people would not only not come forward with clues to crimes, they wouldn't report them ~ just take personal revenge as the opportunity presented itself.

The topic of the lineup has been discussed extensively. 'twould seem it wasn't necessarily improper. After all, you had a whole big bunch of guys who attended the party and who admitted they were there.

To demand that the cops pull in people off the street is pretty much like what TSA does when it subjects old ladies in wheelchairs to body cavity searches down at the airport while looking for terrorists.

What rock have you been living under for the past month?

It was a photo lineup. She looked at pictures. No one was pulled in off the street.

Don't the Durham police have pictures of people other than the lacross team?

How about pictures of the last 500 or so young white guys they have arrested?

They could have identified the single male source in one of two ways:

1. The police did DNA tests on her boyfriend/John(s) (unlikely I think) or

2. The single male source was already in the national DNA database (meaning he has previous convictions or has been tested for other reasons).

Probably the latter. The defense attorneys could have a field day with this guy if he turns out to be a John. They don't want to drag his name through the mud now, but just wait until the trial date gets closer. He is the key to dragging Mangum's sexual history into the open in a way that the rape shield laws can't stop.

While I think he should be called as a witness, I am not a lawyer. Any lawyers out there with an opinion?

My bet is that he is either her pimp or a john. A boyfriend would have been mentioned already.

What do we make of Nifong having the cabbie arrested and intimidated after he had this DNA report, but before he shared it with the defense? At some point his immunity from civil prosecution for doing his job ends if there has been enough malfeasance. It looks like one could start to make a case that his purpose in getting indictments was to advance his personal political career, rather than the pursuit of justice. Not that there was much doubt, but now we have evidence.

Wouldn't it be a grand project for the Duke law school to take on hounding Nifong for a while?

LIEfong is toast, and as this case continues to disintegrate, the black community in the area and possibly even Crystal Mangum will make him the scapegoat for forcing this case on the public. LIEfong was so adamant that dear Crystal had no choice but to go along. Besides, she was drugged by someone, remember? She was confused and coerced into a confession.

THAT would be most fitting and ironic for such a champion of diversity.

That is easy. LIEfong thought he would get the cabbie to retract his story. He also thought one of the players would flip once he leaked the now irrelevant unmatched sample under the Press-On nail. None of the above happened, so he delivered his turd of a DNA report to the defense at close of business Friday prior to a May 15th deadline. Now, he is in hiding until Monday where he may get a 3rd indictment in the secret (and biased) grand jury testimony.

LIEfong is crazy, corrupt, or both. Your choice.
