Ex-wife becomes a man; ex-husband seeks end to alimony

CLEARWATER, Florida (AP) -- Lawrence Roach agreed to pay alimony to the woman he divorced, not the man she became after a sex change, his lawyers argued in a Florida court Tuesday in an effort to end the payments.

But the ex-wife's attorneys said the operation does not alter the agreement.

The lawyers and Circuit Judge Jack St. Arnold agreed the case delves into relatively uncharted legal territory. They found only a 2004 Ohio case that addressed whether or not a transsexual could still collect alimony after a sex change.

"There is not a lot out there to help us," St. Arnold said. Roach and his wife, Julia, divorced in 2004 after 18 years of marriage. The 48-year-old utility worker agreed to pay her $1,250 a month in alimony.

Since then, Julia Roach, 55, has had a sex change and legally changed her name to Julio Roberto Silverwolf. "It's illegal for a man to marry a man, and it should likewise be illegal for a man to pay alimony to a man," said Roach's attorney, John McGuire.

"When she changed to a man, I believe she terminated that alimony." Silverwolf did not appear in court Tuesday and has declined to talk about the divorce. His lawyer, Gregory Nevins, said the language of the divorce decree is clear and firm -- Roach agreed to pay alimony until his ex-wife dies or remarries.

interesting. legally, I don't know how this would go. but knowing how many on here feel about alimony in general, I thought this would be an interesting discussion on a new twist to it.

If religion permits, maybe he could get an anullment on the terms of fraud, and then go to get back all the money he has ever given her/him. It seems there's a bunch of stuff he could sue on.

They usually hold water for a little while, but eventually you will have to go.

If Florida - where crazy things keep happening - recognizes her as being a man, then obviously there should be no alimony and the marriage declared a fraud.

I saw a case on Court TV where the children were taken away from the biological mother and given to a woman who had a sex change operation and declared herself a man. They children were upset - that had to leave with that freaky looking person. Another sick decision made by Florida courts - they must be among the worst in the country.

Legally changed name means Julia is legally a non-entity. Judgement was for her, not Julio.

I'm going out on the limb...but I'm guessing that when the marriage ended...the wife had a lesbian lover. This lover has convinced the ex-wife that she should be a male...and this operation will fix everything up. Not to suggest that the ex-wife is dim...but its a pretty sure bet that she is fairly naive and believes whatever the lesbian lover is telling her.

He agreed to pay her alimony. She is no longer a "her", and the woman he agreed to pay alimony no longer exists as a legal, female, entity.

I'd say the income stream should dry up.

Besides, what guy would want to be paying alimony to a "guy"?

I wonder if the new "man" is now able to marry a women? Or does the state still view the "man" as a women, preventing it from marrying an actual women?
