Spears' Lawyer To Judge: 'You're Not A Pop Star'
CBS2 ^ | 11/08/2007

Because Britney Spears has a number one hit album, she should have more time to show up for court-ordered random drug tests, her attorney told a court commissioner Thursday.

Los Angeles Superior Court Commissioner Scott M. Gordon had given the pop singer one hour to respond when a lab calls her for a drug test.

During an unscheduled hearing Thursday morning, Spears' lawyer, Anne Kiley, called that arbitrary and unconstitutional.

She said Spears should have six hours to make preparations to be tested.

Primary custody of Spears' children -- Sean, 2, and Jayden James, 1 -- is with their father, Spears' ex-husband Kevin Federline. She has visitation privileges that include one overnight stay by the children with her per week.

Federline's lawyers asked for Thursday's hearing to complain that Spears is not complying with the drug testing order and is not responding to calls from the testing facility within the time frame ordered by Gordon.

Gordon said he does not believe Spears should be treated different from other people who get calls from labs in the morning.

"I have to get here at 7:30 a.m. to read (court) papers," Gordon said in reference to documents filed in connection with today's hearing.

Kiley said Gordon's situation is different.

"But you're not a pop star with a number one album," Kiley said.

Kiley also defended Spears for changing her telephone number so often, saying it is necessary because she is famous and people are always getting access to her personal information.

But Federline's lawyer, Mark V. Kaplan, said Gordon's order is a simple one and that Spears has no justification in changing her contact information so often.

"We are all bending over backwards to bring Miss Spears' conduct with that of ordinary people and it is Miss Spears who is the fly in the ointment," Kaplan said.

Gordon ruled there needs to be one number that the testing facility calls for Spears' response. If she changes that number, everyone involved must be notified.

I knew a judge that would have that lawyer cooling his heels in lockup overnight.

She’s not a star with a number one album, either. The latest reports I saw said her new CD had sold around 70,000 less than expected.

Baliff, remove Mr. Kiley and remand him to the Sheriff’s office for 30 days.

She doesn’t care. She does not want those kids. Sure they sounded fun, kinda like a puppy. But when you actually have to deal with them, well they are smelly and messy, and always crying. Plus it is hard to hit the clubs, minus panties, when everyone keeps asking “Where are your kids”.

I am no lawyer but isn’t that considered contempt of court?

Brittney doesn’t care about her kids....if she did, she’d be doing everything she could to follow the court’s orders and pass the drug tests...

IMO, she’s a terrible influence and not a very good “mom”, and it’s a sad state of affairs when Kevin Federline is better for those kids than she is.

When K-Fed is the voice of reason on an issue that involves you, you might be a redneck.

But seriously, I get no gratification from Brit’s missteps. She doesn’t seem to realize that she can easily become a has-been if she hasn’t already, and she sure doesn’t put those kids up as being even close to her top priority. It’s just sad.

My morning drive time DJ’s said yesterday that she has the #1 by default. Her album has sold 350,000 ... the Eagles new album sold 700,000. The one drawback is that the Eagles album is only being sold at WalMart and to be considered for Billboard #1 you have to sell everywhere.

The Fox News website this morning said she had only sold around 280,000, much less than expected. I guess it could still have been #1 due to a technicality, though.

LOL. Actually Billboard changed their minds about it. The Eagles are at the #1 spot. Hopefully Brittney & her album will be forgotten soon.

She doesn’t care. She does not want those kids.

It really isn't about the kids. It is about the child support payments that will go to the custodial parent. Britney rakes in about $750,000 a month income. Those checks to Kevin are going to be pretty fat if he gets to keep those kids.

And, yes, it appears that he is the better parent.

Yep,
when you want your kids, you’ll crawl over glass to get them back.

Sounds like she doesn’t ‘get’ what motherhood is supposed to be.

I'd tell him she better pop in on an hour's notice or I'd pop her butt into jail for contempt for 30 days and see how that affects her career.
