American Jailed Under Patriot Act

This is a report to share with fellow FReepers concerning the Patriot Act. Has anyone heard the name Randy Dees? Randy came to my attention, just recently, via information from a family member, who has known Randy (played music with him) approximately fifteen plus years ago. My family member informed me, one thinks there is nothing that can happen to them under the Patriot Act, but now there is the fate of Randy. My family member thought the Patriot Act was written to protect Americans from terrorists. Now, by the actions taken against Randy, my family member can only shake his head, and is shaken, in his faith, of America's Right to voice or type an opinion. Believe me, the right does not exist.

Randy is an American Citizen, an IT professional, who was working in California, prior to being charged with domestic terrorism under the Patriot Act. I will not insult anyone's intelligence belaboring the benefits or non-benefits of the Patriot Act. Each one, inside the cyber-web community, should be informed enough to realize, that living under the Patriot Act, one can be charged with domestic terrorism, should someone deem an individual a threat by another individual. Randy was deemed a threat because of what he typed on a forum or a blog.

I know not what was typed by Randy, and I do not support violence (Randy's writing may have been interpreted as violence), but sometimes in the heat of an argument, on the web, things are typed or said which may not be what an individual meant to type or say. The post button is hit, and next one knows, one is on one's way to jail. I do not know what was typed by Randy, whereby Randy was arrested, and now is in jail. I will agree the Patriot Act may appear, on the surface to be an Act America needs, but I cannot agree Randy Dees is a domestic terrorist, as charged under the Patriot Act.

Randy is also an Anti-Open Borders American. Till I know differently I have to believe one of the reasons why Randy was locked away, since December of last year, under a bond of more than one-half million dollars is because Randy typed something which caused someone to call the Police. This could happen to any of us, living under the Patriot Act.

Randy is originally from Charlotte, North Carolina. I may have met Randy twelve to fifteen years ago, but neither he nor I discussed politics at that meeting. Randy and I only said a casual Hello, glad to meet you, exchange of pleasantries. Again, I confess, I have not read Randy's writings.

Here in North Carolina, when the boys and girls speak of politics, each of us is normally portrayed as being politically incorrect, backward, Confederate flag waving, misguided cretins, ready to take up arms against the State or the North, unless we belong to the Democrat Party, and the Democrats do run North Carolina and those persons (democrats) are the truly enlightened /sarcasm tag here. Free Speech is not free in our Nation, and even if there is a fire in the theater, the Conservative thing to do is exit the theater in an orderly manner, while if one is politically correct, one refuses to move, sits in the seat while the theater burns down around them. Political correctness is a means to an end. Do not argue for truth in North Carolina, let the building burn down while you sit still is the normal operating procedure. Besides, you'll be hot tonight! Whew, do I need another sarcasm tag?

Again, I do not know what Randy typed on the web, which led to his arrest. But I am warning each of us, living under the Patriot Act, what one types is going to be scrutinized. Since each of us knows this fact, each of us can continue the business of taking back our country, can't we? Maybe yes, or maybe no is my answer.

I do not know if Randy was / is a Conservative, but I do not believe he is a liberal, but Randy may be a liberal, yet Randy did not sit still while the theater burned, nor did Randy attempt to run away. Randy faces jail time, beyond what Randy has already served.

I encourage each person reading (this vanity) to research, with keywords on Google, Randy Dees, California, several pieces of information will come on screen, some will be links to things Randy has written. I have not read any of Randy's writings, but I believe Randy is far more the Patriot, than I will ever be. Besides, if one expresses an opinion, should the one expressing that opinion be jailed?

There is one additional piece of information I cannot confirm concerning Randy. Some of the articles, I have read, say Randy is a former Marine. I do not know this to be true, nor do I know it to be false. My family member says Randy did not serve, our nation, in the Marines.

Each researching Randy's writings should decide, if Randy should have been jailed for his views. Now that I have expressed my views. One day, if my opinion is taken the wrong way, I may be joining Randy in confinement. With all I have written on this forum, nearing 3,000 posts, I may be next to go to jail.

I will pray Randy is released and I will pray I remain free. My family would miss me, as Randy's family misses him.

First of all, you don’t know what he wrote and don’t know if he served...why do you call him a Patriot? The FedGov isn’t into locking up people without cause. Let the facts come out, then you can make a determination on his guilt or innocence. Until then, considering you don’t even know him, I don’t think I’d get involved.

In general, I share your concerns.

However, in particular, I cannot state anything concerning
this person. There are no particularities upon which to
base any opinion. I do not know what he said, to whom it
said it, or in what context the statement was made.

That does not take away from your family’s opinions, but
that is, indeed, all it is. That does not mean weight is
also given to the state, either.

I do not like the government intrusion into, or retraction
of, American’s Constitutional freedoms “in the name of”
MOST anything. Merely expressing opinions, where it puts
no one into danger (as it would with, say, shouting “fire”
into a theater) is removing our right to free speech.

Either we are either free citizens or we are not.

Thank You, for commenting....I have done some research concerning this situation, and I trust my family member, but sometimes research does leave us lacking information, as with the thread, we both, have been on. I do not intend to invite anyone else over to view this post...but may many read. I realize some may do some research and some may not....but my only desire is to warn everyone to not post something in the heat of an argument that may cause one’s family grief. Here is all that can be found on the first 5-7 google posts. Its the same everywhere with no additional data:

They also took many of his important files. The search warrant was for DOMESTIC TERRORISM! This search warrant was issued due to a remark regarding the ACLU on the SOS forum a few months earlier. The post was seen by one of our open borders enemies who complained about it to the San Bernardino Police Department.

> Randy had plane tickets to fly out of LAX the next day, Friday Dec 21 to go home to North Carolina for the holidays. Although he was shaken by the unexpected raid on his residence, he had no fear that any crime had been committed. He consulted with an attorney Friday morning and then packed up for his trip home. At about 3pm on the 21st, Long Beach Police called Randy to tell him a warrant had been issued for his arrest and that he needed to surrender to the Long Beach Police Station by midnight.

They told him if he tried to get on his flight at 8pm, he would be arrested at LAX. Randy notified his lawyer and was told to turn himself in. Randy and a friend went to the police station at about 6pm to surrender to the still unknown charges. He was immediately booked and bail was set at $550,000. Randy was transferred to county jail in Santa Clarita in late December and has been there ever since. He was brought back to Long Beach on Jan. 15th for a hearing and the judge told Randy he is facing 4 1/2 years in prison on still unspecified WEAPONS charges. Randy has another hearing in February. His situation is looking bleak and he has lost confidence in his lawyer. We are currently working with Randy to see how we can help him.

OK... I guess I don’t understand this post. What, exactly about this case has anything to do with the patriot act?

Domestic terrorism (if indeed it has anything to do with this case) was already against the law. There’s also something pretty nonspecific about “weapons” charges. Hard to say what that means, but there’s not much new there either. Supposedly some statements or threats were made but we don’t know the nature of those. There were already plenty of ways to get in trouble for threatening the life or limb of another person, so who knows whether there’s anything new there? We don’t.

He’s been arrested. He’s got an attorney, and he’s getting due process. He’s not in Gitmo, even.

All we know is that some guy has done some things we don’t know and he’s been arrested. Well... so what?

Not a lot to go on. I’ll need a little more info before I think Bush is the bad guy in this.

may I type, President Bush didn't arrest Randy Dees, nor did President Bush report Randy Dees? Looking over this situation, I am simply shaking my head....I do not know what to think, so I simply typed a warning for others. Is the ACLU involved...I do not know.

Thank You for snooping....Two days ago, I saw some things, I did not read, which said were writings of Randy Dees. Found them with keywords: Randy Dees, California. If these alleged writings, of Randy Dees, are gone, the mystery has deepened. Again, Thank You.
