This is an email I received yesterday from Senator Martinez in reply to an email I had sent requesting his support to ensure that Senator Obama provided proof of his eligibility, as a natural-born US citizen, to take the office of President of the United States.
Thank you for contacting me regarding President-Elect Obama's citizenship. I appreciate hearing from you and would like to respond to your concerns.
Like you, I believe that our federal government has the responsibility to make certain that the Constitution of the United States is not compromised. We must fight to uphold our Constitution through our courts and political processes.
Article II of the Constitution provides that "no Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President." The Constitution, however, does not specify how that qualification for office is to be enforced. As you may know, a voter recently raised this issue before a federal court in Pennsylvania. On October 24, 2008, the United States District Court for the Eastern District of Pennsylvania released an order in the case of Berg v.Obama.In that case, the plaintiff, Phillip Berg, raised the same issue that your letter raises regarding proof of the President-Elect's birthplace. Through his lawsuit, Mr. Berg sought to compel President-Elect Obama to produce a certified copy of his birth certificate.
The District Court dismissed Mr. Berg's suit and held that the question of Obama's citizenship is not a matter for a court to decide. The court further noted that voters, not courts, should decide whether a particular presidential candidate is qualified to hold office.
Presidential candidates are vetted by voters at least twice - first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party's nomination after one of the most fiercely contested presidential primaries in American history. And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama's birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of President.
After he is sworn into office, Mr. Obama will be our nation's President and I intend to bestow upon him the honor and respect due any man who holds that Office. Yet, I am certain that there will be times when I will disagree and oppose President Obama's policies. When that happens, you can be assured that I will pursue vigorously what I believe to be in the best interest of Florida and the nation.
I thank you for sharing your views with me and will keep your concerns in mind. If you have additional questions or comments, please contact me. For more information about issues and activities important to Florida, please sign up for my weekly newsletter at http://martinez.senate.gov.
United States Senator
Unfortunately there have been a number of people, like the $100,000+ per year city manager in San Antonio, TX, a number of years ago who came with very impressive credentials. It turned out that her credentials were falsified, and she, because she was a minority, had not been vetted properly by the overawed screening committee before she was hired. Just because Zero won the Democrat primary doesn't mean that he was vetted properly. The Democrats saw him as a winner and couldn't care less about his qualifications.
Mel obviously doesn't understand that if Zero does not meet the constitutional qualifications to run for president, as president, he will likely pick and choose other parts of the constitution to ignore. The suits are not intended to bring the Zero down, they are to compel him to produce official records that prove that he meets the constitutional requirements of the presidency.
Martinez has adopted jive talking as his new language. Did it right after the 2006 election.
Hire the handicapped.
Voters vetted Obama twice? How are they supposed to do that?
So, the words in the Constitution do not matter if the people decide to ignore them? I guess that is how the GOP ended up where they are today. God help us.
“The Constitution, however, does not specify how that qualification for office is to be enforced.”
I have no response to that. That’s just amazing. This is why the GOP is dead to me.
Mel does not know the difference between the words: “vote” and “vet”??? He also doesn’t know his left hand from his right???
Send it back to him with a note that says:
“Dear Senator Martinez,
Thought you would want to see what some idiot in your office sent out under your name.”
The Constitution also is short on instructions on how to enforce most of its instructions, yet the Courts have seen fit to intervene in all other cases.
Wow! How timely was this??!!
JUST NOW saw on TV that Martinez is to announce he is not running for reelection in 2010. They went on to say that he may step down early and let Crist appoint a replacement.
No other details just yet.
This was from an Orlando station.
Mel Martinez is a traitor to this country, and he should be treated as such.
Scum can hardly begin to describe this scumbag.
I got the rino’s email yesterday too. I replied, lambasting him for becoming a US Senator without any clue what the Constitution says.
I am SO glad he’s not running again.
So, qualifications are just matters of opinion, sort of like a living Constitution is whatever one wants it to be.
No, not unbelievale - Mob Rule, like illegal immigration, is now the LAW, direct from a US Senator.
This man has no clue what vetted means. He thinks voting means vetted. This is BS
