Well the dog's in danger.
Here in the northeast the game wardens will summarily shoot any dog that chases deer.
The only humane thing to do is to ensure that the dog remains tied up. It can't be allowed to run free.

In my state you would be breaking the law and fined. You may have to keep him restrained.

Yes. I would shoot it immediately. I would also shoot any dog I saw chasing a deer. Not long ago this was considered common sense.
Don't let your dogs start chasing deer.
