Strip-Search of Girl Tests Limit of School Policy

"The US Supreme Court has agreed to review a case involving the strip-searching of a 13 year-old girl who was accused of possessing prescription-strength ibuprofen on school grounds, in violation of the school's zero-tolerance drug policy. The case has gained national attention because of the defining role it will play in determining which, if any, parts of the Constitution apply on school grounds. In Morse v. Frederick, the Supreme Court has already upheld the right of school administrators to restrict students' free speech at school-sponsored events that take place off school property.

The school described the strip-search as 'not excessively intrusive in light of [the student's] age and sex and the nature of her suspected infraction.' The Supreme Court's last decision about searches on school property dealt only with searching a student's purse. Incidentally, the girl was found not to be in possession of any drugs, illegal or otherwise."

If I ever have a teenage daughter and any school official even gets in her personal space then I think my state of mind would go beyond rage.

I wonder if prior to violating her they bothered to call the parents to see if she had prescription, or if the parents had one. (/sar)

This is a good example of how our society is in decay.

My guess would be that the supreme court will side with the school. I don't believe that schools should be allowed to do this but the supremes often side with giving power to the government.

No, a lawsuit is too good. This guy needs a serious ass beating.

How does this square with the 4th Amendment as the school as an agent of the State?

I know locker searches are now the norm, but this seems to stretching things a bit?

What the hell does “prescription-strength” ibuprofen even do? I cannot imagine why someone would abuse something like that unless they’re in serious pain.

The whole public education thing is absurd anyway.A grad student T.A. can teach an 18 year old calculus but not A.P. calculus to his 18 year old friend at High School.

That position seems a little extreme. People pay taxes that for school, and not everyone can afford the cost of private school on top of that.

Just exactly what is prescription-strength ibuprofen?

My Dentist said he could prescribe 600mg or 800mg Ibuprofen or I could just take three or four of the less costly over-the-counter 200 mg Motrins.

Is a search warrant issued with probable cause required to search a person?

It seems a bit ironic that schools require a parents’ permission for the child to take aspirin but will assist that same child in obtaining an abortion without notifying the parents.

I wonder if they resort to strip searchs looking for methylphenidate (Ritalan)?

The term is vague, and typical of the sloppy 'journalism' we see today.

Retail ibuprofen is not sold in tablets larger than 200 mg. Most scripts for ibuprofen specify 800 mg tablets. I suspect (but obviously do not know) that this was this situation here.

My son is in the 7th grade, probably reads on a 4th or 5th grade level yet does math on an 8th grade level. He is failing science. He just received a book report assignment - book must be (get this) at least 100 pages. His report isn’t a report at all, it’s more of a fill in the blanks crock. I had to teach him how to outline a story. He had no clue. When he told me they were reading a book together in class I was thrilled, until I found out they were ‘reading along’ to a cassette tape.

I do not agree.

I have no option but to send my girl to public school. Thankfully, this one is not bad.

Homeschooling is out for me, I have to make money to pay the mortgage. Private schools around here are over 15 grand a year.

I got to know some of my girls teachers. If she needs something, she goes to them. She goes to them.

This is not big city, but a large, sammler public school...

This seems to me to be sexual abuse of a minor...A principal or asst. principal should not have the authority to strip search any child...Its gives a pervert in the school the right to strip search any child...An ass beating is too good for this slime...a double tap from mom and dad is called for if it was my daughter...

You can guess my advice. We home schooled and then she went to 3 years of High School. Well, in 2004 she graduated with excellent grades (at age 20) from one of the best liberal arts colleges in the country. And still thanks us now and then for the home schooling.

I think yours was the best approach. I was homeschooled all through high school, and it was definitely a good education (though I’m not sure even the education in high school was better than my peers got at good public or private schools). But I am pretty sure I would have been better off going to high school, both for social reasons and because it would have broadened my perspective in many areas.

As frustrating and infuriating as it was at time (for her and us), several years in HS did serve a purpose in that regard. And some of her personal associations were of much importance. Academic benefits however were pathetic.

And she learned first hand about how stupid administrators in public institutions can be. A real lesson in life.

You get prescription strength ibuprofen by taking more than 2 of the over the counter pills. If you take too much of it you can cause liver failure.

I figured. So basically, if you wanted to “abuse” ibuprofen all you’d have to do is take a few more over-the-counter pills (I have a bottle of 500 of them sitting next to me—maybe I’m a hazard to society?). I cannot understand why the school would suspect she was abusing or care whether she had ibuprofen, except that it gave them an excuse to exercise their power over her.

It will be a bad idea if the Supreme Court rules in favor of the school, and if that happens, parents will have to make a decision as to whether they want their kid treated like a common criminal by a bunch of pencil-necked school administrators.

Public school isn’t worth the aggravation. There are so many better options.
