(Military.com) Anti-Obama GI's Afghan Orders Revoked
Military.com ^ | July 15, 2009 | Bryant Jordan

Posted on 07/15/2009 1:36:42 PM PDT by real_patriotic_american

The attorney representing an Army major fighting deployment to Afghanistan because he believes Barack Obama is not legally his commander-in-chief is declaring victory after the Soldier's orders were revoked yesterday.

California lawyer Orly Taitz says any service member may now refuse any order by questioning Obama's legitimacy.

"Do you know what this means?" Taitz asked in a telephone interview with Military.com Tuesday, about an hour after hearing from Maj. Stefan Cook, the officer fighting his deployment to Afghanistan. "It means the Obama administration has blinked. They have no cards to play with. The moment I filed a lawsuit, they didn't even fight!"

Per Article 2, Section 1 of the U.S. Constitution, one must be a natural born citizen to serve as President. Why won't Barack Obama present his original long form birth certificate to prove whether he is eligible to hold office or not?

They might be revoking his orders because they are going to court martial him. This story is not over yet.

I read that they are going to discharge him. Whether he gets Court Martialled is up in the air. This definitely has the “smell” of the White House trying quash any questioning of zer0’s qualifications.

Not a very good attorney if she is celebrating already.
There is no way in hellthat Obama and his minions will let this man off scott free. watch in the coming days as he gets everything in his life destroyed, court martialed in a manner that does not allow the defense he wouldwant to use or he simply willnopt be allowed to useit.

If he gets court martialled he can press for the birth certificate to be entered as evidence.

I’ll bet he gets an honorable discharge. that will be the proof that the Major is right.

You are correct. They have already had him fired from his military contractor job. See Breaking News here.

Good luck with that.
While the majority ofmen and women in the military may think Obama sucks and may agree that he isn;tor shouldn;tbe the President the military does nottake those that disobey orders lightly for ANY REASON.

Major Cook was just fired from his job with a civilian defense contractor.

That will give him two people to sue - US Govt and the company. Firing is a little Chi-Town payback from you know who and very low.

Why can’t our distinguished, patriotic President simply present his original long form birth certificate to prove his eligibility? Actions speak louder than words.

It means his case is under consideration. The Major is now in an undeployable status.
I too would like to see proof that President Obama is legit - but this is no big thing, it’s just the normal routine.

Proving eligibility is more than normal routine when it’s the #1 position in the country. Hey B. Hussein Obama, where’s your birth certificate?

Yes, I haven’t seen the proof either - but Barrack Hussain Obama was sworn in as our President. Like it or not, he is our President and Commander in Chief until removed from office.

Earlier today, Quon said Cook submitted a formal written request to Human Resources Command-St. Louis on May 8, 2009 volunteering to serve one year in Afghanistan with Special Operations Command, U.S. Army Central Command, beginning July 15, 2009. The soldier’s orders were issued on June 9, Quon said.

“A reserve soldier who volunteers for an active duty tour may ask for a revocation of orders up until the day he is scheduled to report for active duty,” Quon said.

Not if such swearing occurred under demonstrably false conditions, in which case Plugs the Wonder Gaffe would become President. Same thing if Joe Jones impersonated Senator-elect John Smith at the swearing in; the swearing is void on the spot (or, once the personation has been demonstrated), and the lawfully elected person, Smith in this example, would be sworn in and take his seat.

Thanks, real_patriotic_american.

Before news of the deployment orders being revoked were reported, MSNBC anchor Keith Olbermann tonight called Cook a "jackass" and Taitz a "conwoman," as he labeled both of them the "worst persons in the world." He flayed the soldier as "an embarrassment to all those who have served without cowardice."

Great. We have laws being passed by people who do not even read them. We have a President who is probably not even eligible to be president. Screw DC. They don't order me around anymore.

They might be revoking his orders because they are going to court martial him. For what? UCMJ Article 92 (Failure to obey order or regulation)?!

He didn't defy an order -- he questioned the order pending further information, in a respectful and legal manner in a civilian court room.

And before he had a chance to "defy an order", the DoD canxed his deployment orders. Then, they fired him in retaliation.

Article 86 (AWOL)?
Article 87 (Missing Movement)?
Article 88 (Contempt toward officials)?
Article 89 (Disrespect toward superior commissioned officer)?
Article 90 (Assaulting or willfully disobeying superior commissioned officer)?
Article 133 (Conduct unbecoming an officer and a gentleman)?!
Article 134 (General Article - "catch-all" encompassing offenses not listed)?!

Please ... anyone ... quote me a UCMJ Article you think Major Cook has violated.

I see NONE that can't lead to the Public Spectacle the Pentagon and Obama want to avoid!

Issues to consider:

He originally volunteered for the tour and according to military.com he never requested to stop those orders, which he could have done

He is a reservist...someone correct me but unless he is bound by some special program, he can resign his commission before a court marshal is conducted

A court marshal would be great (Not for roaddog, sorry) - but it would force the BC issue into the military court, right????

“Yes, I haven’t seen the proof either - but Barrack Hussain Obama was sworn in as our President. Like it or not, he is our President and Commander in Chief until removed from office.”

Major Cook's response to the Pentagon should be that he cannot, in good conscious and in compliance with his Oath of Office (US Code Title 10), follow any orders that trickle down as an Executive order until Mr. Obama reveals his records to prove his legitimacy ... except those orders issued by Vice President Biden.

Article II, Section 1:

Clause 5: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Article II, Section 2:
Clause 1: The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

Article II, Section 1:
Clause 6: In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, (See Note 9) the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected.

Keeping this as a Constitutional argument will flame more curiosity and passion than trying to couch it in terms of the UCMJ and DoD Regulations that the Pentagon will attempt to flail (and intimidate) him with.

Major Cook may also be covered by some Federal Whistleblowers Act.

However the end result, I see that big day coming soon when Obama’s birth certificate and documents are presented to court. He’ll soon be packing his bags for a move out of the White House.

Are people required to be a natural born citizen to be a member of Congress?

Yes for Senator and I’m not sure for the House. For example, Obama may have been ineligible for the Senate as well.

I see NONE that can't lead to the Public Spectacle the Pentagon and Obama want to avoid

Hey I'm not arguing with you here. I think they might try to court martial him. But what do I know?

There would seem to be little doubt of that. Sotomayer, too — there is exactly ZERO way that she can take the oath of her office WITHOUT perjuring herself in the process.

When it is proven that Obama is foreign born he will removed from office. Until then he is our sworn President. The same as in the hypothetical senatorial case you presented - as you mentioned, the imposter would be removed and the rightful senator would be sworn in.

The real question I see in upcoming events is that lets say Obama steps down or is removed from office and not necessarily because he is ineligible.

And then some committee decides to bring to trial all officers that took orders from Obama say in Afghanistan are then put to court as war criminals.

Theoretically with my limited legalese learnings I would say that those officers could be convicted of war crimes as almost anybody on earth by now is aware that Obama does not legally have the credentials to prove according to the Constitution that he CAN be acting POTUS.

As much as Obama is trying on the internet and with his connections to the MSM its too late to convince America that he is truly without a doubt a natural born citizen.

If a street hobo finds a police uniform and dons it and starts issuing tickets for people that actually do break laws do those people have to pay the fines? Can the be arrested? Can the imposter arrest anyone? Give orders to disarm and be arrested?

Thats exactly what Obama is doing, and STILL too many people worship him in a mindless daze.

I support any military officer that questions this, its their sworn duty to defend the Constitution from enemies foreign AND domestic, period. Obama has not to date proven he is credible and is in the highest aspect doubtful as to his legitimacy.

Orly Taitz has something here. Each move she is making is opening up a bigger can of worms for Obama’s defense. Accusations of forged documents (COLB), 39 social security numbers, etc., etc., etc. He’ll soon be packing his bags for a move out of the White House.

Tell me, what would happen if BO is deemed a usurper? I am suspecting Biden would take over temporarily but would there be another election as the one placing Biden as second in command would be null and void based on falseness and ineligibility to run (BO) in the first place. The election would have to be done all over again, right? And, with Palin positioning herself out of Alaska by the end of July....

I’ve always been a believer of things happening for a reason. Seems like the good Lord is setting up His ducks in a row...Mayby, huh???
