(Military.com) Anti-Obama GI's Afghan Orders Revoked

The attorney representing an Army major fighting deployment to Afghanistan because he believes Barack Obama is not legally his commander-in-chief is declaring victory after the Soldier's orders were revoked yesterday.

California lawyer Orly Taitz says any service member may now refuse any order by questioning Obama's legitimacy.

"Do you know what this means?" Taitz asked in a telephone interview with Military.com Tuesday, about an hour after hearing from Maj. Stefan Cook, the officer fighting his deployment to Afghanistan. "It means the Obama administration has blinked. They have no cards to play with. The moment I filed a lawsuit, they didn't even fight!"

They might be revoking his orders because they are going to court martial him. For what? UCMJ Article 92 (Failure to obey order or regulation)?!

He didn't defy an order -- he questioned the order pending further information, in a respectful and legal manner in a civilian court room.

And before he had a chance to "defy an order", the DoD canxed his deployment orders. Then, they fired him in retaliation.

Article 86 (AWOL)?
Article 87 (Missing Movement)?
Article 88 (Contempt toward officials)?
Article 89 (Disrespect toward superior commissioned officer)?
Article 90 (Assaulting or willfully disobeying superior commissioned officer)?
Article 133 (Conduct unbecoming an officer and a gentleman)?!
Article 134 (General Article - "catch-all" encompassing offenses not listed)?!

Please ... anyone ... quote me a UCMJ Article you think Major Cook has violated.

I see NONE that can't lead to the Public Spectacle the Pentagon and Obama want to avoid!

Issues to consider:

He originally volunteered for the tour and according to military.com he never requested to stop those orders, which he could have done

He is a reservist...someone correct me but unless he is bound by some special program, he can resign his commission before a court marshal is conducted

A court marshal would be great (Not for roaddog, sorry) - but it would force the BC issue into the military court, right????

Major Cook's response to the Pentagon should be that he cannot, in good conscious and in compliance with his Oath of Office (US Code Title 10), follow any orders that trickle down as an Executive order until Mr. Obama reveals his records to prove his legitimacy ... except those orders issued by Vice President Biden.

Article II, Section 1:

Clause 5: No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.

Article II, Section 2:
Clause 1: The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he may require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

Article II, Section 1:
Clause 6: In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, (See Note 9) the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected.

Keeping this as a Constitutional argument will flame more curiosity and passion than trying to couch it in terms of the UCMJ and DoD Regulations that the Pentagon will attempt to flail (and intimidate) him with.

Yes for Senator and I’m not sure for the House. For example, Obama may have been ineligible for the Senate as well.
