What the commies are doing is holding battlefield actions to the same level as peacetime law enforcement.
Its consistent with them questioning every shoot decision our troops make.
Watch the videos from the war. They usually take a significant amount of time collecting evidence that the guy digging a hole in the road at midnight really is building a IED.
Next thing you know, the military is going to:
1. Not return Fire
2. Warn the Enemy Prior to Firing
3. Take care not to injure the Enemy
4. Read them their rights
Oh, dang, thats already happening
What will the jurists do if they receive death threats from Al-Qaeda members? Plenty of those inside the country already.
I think it was Judge Roy Bean who said “We are going to give you a fair trial and a fine hanging”
It is ludicrous to think that a fair trial cannot be held by people who already have heard evidence and are predisposed to an opinion. Fairness requires that the evidence be considered and a judgement made. Nothing more.
I still advocate for a professional juror pool to stop juror shopping by both sides.
Voir Dire AKA jury tampering will take years. The only jury candidates without opinions or preconceived notions live in remote cabins.
Hopefully, an angry Manhattan mob will rip them apart on the courthouse steps.
That would be sweet.
I can see the headline, “BREAKING NOW:911 BULLETS FIRED as NY Police Gun Down the 911 Defendants when they tried to Escape Custody”
Nah, the police just need to park the van, unlock the doors, leave the perps alone on the street unguarded, and go get donuts.
It seems to me that the defendants should refuse to waive their right to a speedy trial. This will pressure the prosecution and increase the chances of appealable errors.
I don’t know about federal court, but in my state, once the charges have been filled and the defendant is charged, the prosecution has only 90 days to get the case to trial on a felony, unless the defendant waives this right.
In any case, I strongly suspect that these terrorists are going to make a mockery of our system and eventually walk. Or, their friends will help them to become martyrs and blow the place up.

Not to mention all of the jurors facing contempt of court charges.
