I think that's exactly right. When, in actuality, all this goes back to some laws that were enacted subsequent to the Watergate debacle. Prior to the enactment of those laws, there really wasn't anything governing the destruction or archiving of the Presidential work product. Essentially, the outgoing President threw out what he wanted. Those laws changed all that.
But, Reagan wanted to protect Executive Privilege for himself, past Presidents and future Presidents. So, his legal counsel came up with these guidelines; which is essentially still mandating the archiving of these records, but is limiting their release from the archive when the Executive exercises privilege.
Are Executive Orders a regular order of business, or are they only able to be issued during a state of emergency, as I once heard?
Power down, Hotdog. The Order applies to Presidential records, not personal records. This is a standard order which is entered by each President as he enters office. It simply establishes an orderly procedure for dealing with requests for Presidential records and maintenance and assertion of Executive Privilege. It wouldn’t surprise me a bit if Obama had copied and used the one Bush entered when he took office.
