Where the hell did you come up with girls raping her? Where the hell did that happen, and why arent they being charged with sexual assault then? Im not defending anti social behavior, but being charged with a CRIME for taunting someone? seriously?? So if you and I go to a Tea Party Rally and shout down a liberal congressman, and then protest outside his office every day for a year, and he wacks out and kills himself, we should be charged??

Jury Instruction - Homicide

MANSLAUGHTER IN THE SECOND DEGREE

Manslaughter in the second degree is defined as the unlawful killing of a human being without malice either express or implied, and without intent to kill or to inflict the injury causing death, committed accidentally in the commission of some unlawful act not felonious, or in the improper performance of an act lawful in itself. Manslaughter in the second degree may be committed by the doing of an unlawful act, or the doing of a lawful act in an unlawful manner, although at the time the defendant did not actually know that the act would result in homicide, and this notwithstanding, after the act was done, or while in progress the defendant used ordinary care to prevent the taking of human life; nor is the intention to take life necessary in a prosecution for this offense.

Again, it's up to the jury to decide whether or not what the bullies did rises to this level or not.

In this day and age, I find it really hard to believe that they didn't / couldn't forsee this consequence as a result of their torment. I wouldn't be surprised if the prosecution finds evidence that it was their ultimate goal, or hope. There are some seriously nasty, vicious kids out there.

I work in Law Enforcement, and I have begun to become very concerned at the direction lawmakers are taking with criminalizing, basically what boils down to speech. Im not disputing they can be charged, its if they should be charged.

That's fine. You can be concerned.

But the ultimate decision is with the 12 jurors, in a fair trial. That's how it works.

I'm sure the defense will raise the freedom of speech issue, and the jury will have to consider it.

(P.S. I've been a LEO too. It's frustrating work for many reasons. You have my respect and gratitude for your work.)

If you don't mind my asking, do you have any daughters? I do. This story hits home for me, not because my daughters have been bullied (that I know of), but because I have some idea just how deeply some emotional things can affect them. Depending on the girl, relentless, abusive verbal torment can cause lifelong psychological damage. ...and that's if she doesn't hang herself.

It can be a very real harm, not just an overreaction. Usually, serious damage of this type is done by a parent or sibling, but it's very often a life-changing and personality-changing experience.

Public education is not worth the grief. It’s certainly not worth getting physically attacked. I hope the mother sues the crap out of the administration and school board. I don’t care if people complain that suing will just raise school taxes. Too damn bad. Maybe the taxpayers will smarten up and see who they have running these Lord of the Flies public schools.

I hope these kids are hounded forever.

When I was in school teachers did NOTHING to stop bullying. Ever. In fact, they were often friendliest with those who did the bullying. My guess is nothing much has changed.

My thoughts exactly.

Good God! Did you read all the facts of this story? They were following her home, they were following her to the bathroom, they had this poor girl terrified and she was 15 years old.... not an adult... she clearly felt she couldn’t take any more and checked out.. the Velasquez girl was given all of one day suspension over the bullying........ do you have any idea how mean and cruel kids this age can be?

It doesn’t, and you’ll notice I didn’t say “consensual,” but only “had sex.” There hasn’t been, to my knowledge, a clear narrative of the events published.

Was the “statutory rape” with which the 18-year-old has been charged forced on the girl as part of the harassment, or was it a hookup in which she voluntarily participated? I don’t know. However, it’s unlikely they’d be charging him if the act hadn’t happened, one way or another.
