...and what is wrong with profiling, racial or otherwise, if by profiling you mean that the police will concentrate of the group most likely to be breaking a given law?

So the police can detain a Hispanic because they believe that his may be an illegal alien>

And the police can detain a group of young black males who might be on their way to break into a home?

And the police can detain a middle aged white guy who might be on his way to fly his airplane into an IRS building?

Does not look like a violation of the Constitution to me. If somebody can't speak English then you have reasonable cause to investigate further. As to violating the 14th admendment it starts like this:

All persons born or naturalized in the United States...

Hard to violate that if you are not a citizen. This is a State law and powers not reserved specifically to the Feds are reserved for the States. The Constitution gives States wider latitude since it is easier to vote with your feet to another State than another country.

The RAT congressmen in Arizona really hate this law because it will shut down the little Mexico welfare fiefdoms that keep them in perpetual power.

If the federal law enforcement apparatus cannot handle it, then what makes us think that turning local LE lose on the problem will fare any better?

Are you living in LaLa land? Federal law enforcement, by intent or otherwise, does not effectively enforce the immigration laws. That is quite obvious is it not?

And I do believe local law enforcement readily and willingly participates in enforcement of federal crimes does it not? I mean if you rob a federally insured bank can you not be apprehended by a local sheriff?

There are RICO laws where it is a federal crime to harbor or protect illegals, are there not?

The hypocrisy is in the federal government not enforcing the very protections it has promised the taxpaying citizen.

The Arizona initiative is to address that hypocrisy, heavy handed or otherwise; and you can be sure that local law enforcement properly authorized and properly controlled will help correct that federal impotence quite effectively.

You do agree that this nation is being invaded and this is a serious situation, no?

If the Constitution allowed individual States to have SLAVERY (and it did) then surely the States could deal with non-citizens however it saw fit.

Notice that the Framers of the 14th Amendment used the word “person” when dealing with due process and equal protection.

If they had only wanted these rights to extend to citizens, they would have used the word “citizen” and not “person.”

I’m conflicted...

I very much understand the need for this, yet it doesn’t quite sit right. What mischief can be wrought with this resting in the wrong hands?

But we have dead Americans every day.

So how dies arresting an ILLEGAL alien violate that? They get their day in court, and the law applies equally to all illegal aliens, even though it is harder to catch one that spoke perfect English.

That may be statistically true nationwide; but it is certainly not true in the border areas. I know it is hard to understand the situation when you are not close to the root of the problem. The people in Arizona are fed up- Phoenix is 2nd in the world in kidnapping- behind only Mexico City itself. The kidnappings in Phoenix are directly related to illegal immigration and smuggling. Rural areas of Arizona have a huge crime rate for their population, directly related to the border issues.

NONSENSE. Is it ‘racial profiling’ or otherwise objectionable for the police to stop and question every ‘middle aged bald white male driving a Lincoln Navigator’ if that is the description of the guy that just robbed a liquor store ? Of course not. Well, living here illegally is a crime. A CRIME has been committed. Of COURSE police should be looking for perpetrators and using the best description available. There is no difference between the illegal immigrant — who has been reported as being ‘Mexican and Spanish speaking’ — and the robber who was reported as being white, male, and balding.

You say you ‘understand illegal immigrants are a problem’ but you don’t seem to realize that their simple presence is illegal. They don’t need to have committed ADDITIONAL crimes like rape, murder, or robbery. They are ALREADY criminals. The Federal law requires any visitor to this country to enter by a legal point of entry and carry their passport and visa with them AT ALL TIMES while within the country. Failing to do that is a crime and warrants deportation. Giving the appearance of being a foreigner has ALWAYS been enough justification for law enforcement to question you and require you to show your visa and passport. Arizona is passing their own ‘trespassing’ law only because the libs in Washington DC refuse to enforce the Federal immigration laws.

People like you forget that each State is its own Republic, with its own borders and the right to control those borders guaranteed by the 10th Amendment. Even in California, driving into the state from Nevada, Arizona, and Oregon, you will be stopped and asked questions. It is to stop people from bringing in fruit that might be infested with fruit flies and other pests. States have the right to control their own borders to protect against dangers to their economies and health. Illegal immigrants pose a danger to both health and economy.

What you call ‘racism’, I call ‘being minimally observant’.

I’d like to see a mine-field along the border. They wouldn’t need to be deadly — just release a cloud of permanent ink. Setting off a mine would trigger a Border Patrol response looking for people who are purple or wrapped in cellophane. Then American employers can’t claim ignorance if they hire purple people, and “purples” can be readily identified by police for deportation. Purple isn’t a “race”, right ?

So Arizona has now made it a LOCAL CRIME to trespass in their State. By your logic, it is now perfectly fine for it to be the local police’s job to round up these trespassers.

Glad to see you agree and applaud Arizona’s solution.
