Washington • Sen. Orrin Hatch said Friday he will vote against Supreme Court nominee Elena Kagan, marking only the second time in 34 years the Utah Republican has objected to a president’s pick for the high court.

Hatch said he is not convinced that Kagan wouldn’t become an “activist” justice and that she fails to meet the standard to which he’s held previous nominees.

Hatch is thinking of Robert Bennett - the other RINO in Utah. Hatch knows he is next.

I wish the people of SC and FL were as good as the fine folks of UT in dumping stinking RINOs. Ditto with wonderful AZ (Brewer - woo hoo!) which I hope dumps horrible McCain.

“Over nearly 25 years, [Solicitor] General Kagan has endorsed, and praised those who endorse, an activist judicial philosophy,” Hatch said in a statement. “I was surprised when she encouraged us at the hearing simply to discard or ignore certain parts of her record. I am unable to do that. I also cannot ignore disturbing situations in which it appears that her personal or political views drove her legal views.”

No but he saw RINO Robert Bennett get toasted in the primaries by the good folks of Utah. Hatch is worried he will get dumped in his primary in 2012 (?).

While Hatch's announcement gives marching orders to the other more moderate Republicans, like Grassley, Voinivich and Dick Lugar, you've got to imagine that Collins, Snowe and Graham are about as close to a sure thing as you can get.

I'm not sure where we're going to find three Dem Senators, although there's been some speculation Specter is a no, based primarily on his contentious questions of Kagan, his 'no' vote when she was being confirmed for Solicitor, and his general disposition to Obama since Barry left him twist in the wind.

Maybe some heat could be put on Lincoln since she's in a very tough fight, and Ben Nelson. Evan Bayh has deeper political ambitions, but I'm not sure a no vote here helps him with moderates more than it hurts him with his base.

good...but it won’t do any good...he should be standing tall and saying he is voting “no” for his children and grandchildren...because way after he is good she will be destroying our families, country, principals, honor and way of life!

I fail to see how anyone who professes to believe in the law and/or the Constitution could possibly vote to confirm her.

She broke the law while she was the Dean of Harvard School of Law. Not only was she in violation of the Solomon Act, but her "excuse" for doing so, "I hoped that the military would not enforce the policy," is an attempt to encourage the military to violate the law. Isn't that suborning criminal behavior?

If Grahamnesty votes to confirm, he should be removed from office by the voters in a recall, as should any Republican who does so.
