Sen. John Kerry in Violation of the Jones Act?

John Kerry was busted for trying to evade high Massachusetts taxes for his new luxury yacht by berthing it in Newport, RI - very far from any of his residences, and surely a tax cheating ploy by this tax & spend Democratic sanctimonious hypocrite.

The part of this story that people seem to have missed, comes when his Chief of Staff, David Wade denied that the old poodle was berthing his boat out of state to avoid paying his own taxes to his own tax-ridden state.

“The boat was designed by and purchased from a company in Rhode Island, and it’s based in Newport at the Newport Shipyard for long-term maintenance, upkeep and charter purposes, not tax reasons,”

The fact that he plans on chartering a foreign built boat out in US waters now makes him clearly in violation of the "Jones Act" and "Passenger Services Act" which require that any boat that takes on charter passengers in US waters be built in the USA.

Kerry was obviously looking to avoid paying about $500,000.00 in sales and property taxes that the Democrats imposed on us little people. His spokesperson has lied to get him out of one boiling pot and placed him squarely into another. So which law is he flouting -

Quick search shows a 75’ sailing yacht (very similar to Kerry’s) in New England runs for about $15,000 a week. But bear in mind there would be additional charges for fuel, food, dockage, etc. incurred by the users; so add another $10K or so, depending on lifestyle considerations. LOL.

Yes, I posted it as CHAT and a vanity with a link to where I got the quote from his spokesperson.

Everyone seems to miss the fact that the Senator thinks it is okay for him to flout both tax laws and the Jones Act.
Nobody seems to have picked up on the fact that his spokesperson admitted that he intends to violate the Jones Act.

If you look at my Post #1, you will see that BHO thinks it is VERY important...

They can build it much cheaper as they do not have those rigid Massachusetts labor laws, unions and taxes that make Massachusetts manufacturers totally uncompetitive.

This is an undeniable FACT and if we had a news media who would do their job, it would be covered as such on every network and every "news"paper in the country. He’s a tax evader for sure, but the yacht is technically owned by an LLC in Pennsylvania. That’s Mama T’s legal residence for tax purposes.

Jones act was cited as the reason the aid ships offered to help with the gulf spill were initially told no. It took an exemption months later for them to be allowed in.
Mind you,from what i’ve read Obama could have told congress we need this temporary exemption and would have gotten it right away.

It doesn't matter who owns it, the Jones Act is crystal clear in that any boat which sails between any two US Ports must be:

Exemptions are available for boats that carry less than 6 and 12 passengers. Highly unlikely for a multi-million dollar 75 footer.

My case is about the Jones Act angle, not the tax angle.

Great! I'd like to see Kerry continue to use all of these excuses to defend his buying a foreign built boat and birthing it in another state to avoid paying taxes. Legal maneuvering or not, Massachusetts voters will see Kerry for what he is.

Yes. I doubt that anyone could charter it sans captain or crew (i.e., bareboat basis). Rough approximatation for captain salary used to be about $1,000 per foot but that may be low given the area and a host of other factors. The entire electronic suite onboard boats these days is pretty complicated and mechanical knowledge required to run them can be daunting, not to mention seamanship considerations.

Finished in New Zealand( maybe ). Check.
Bought by the trust fund ‘investment’. Maybe. Check.
No Sales Tax. Check.
No yearly local tax. Check.
Expenses, crew, fuel, dock, maintenance ALL dumped in ‘Charter Account’. Check. ( Not like you little personal car owners who only get a bit taken off. Suckers ).
Use the boat, fuel, crew, food, booze, dockage for personal fun. Check.
Take losses and apply to earnings, thus lower taxes. Check.

This sail boat is very un-likely to carry 12 passengers, except on day trips. there isn’t enough room on board for enough staterooms.

Your post was misleading in the sense that the article you cited said nothing about the Jones Act. Apparently the only source you have for the supposed Jones Act violation is your own opinion.

I can tell you that foreign built boats are chartered in US waters all of the time, and a 75 foot boat with Captain and crew is not particularly large or at all unusual in the charter business. I seriously doubt that chartering this boat will constitute a Jones Act violation.

I have no doubt that Kerry is trying to avoid the Massachusetts sales and excise tax, but he is by no means assured of success. In my home state of Maryland, a similar situation exists with respect to the State of Delaware. Delaware has no sales tax, and somebody buying a boat in Maryland can save the excise tax (which was 5 percent when I bought my boat but I think is now 6 percent) by buying the boat in Delaware and using a Delaware hail port in her documentation. However, Maryland is very aggressive about going after these boat owners if the boat shows up in Maryland waters with any regularity. The Maryland taxing authorities regularly send investigators to marinas to check the names and hail ports of boats docked there. They pay particular attention to boats from Delaware that have no Maryland stickers. Massachusetts undoubtedly does the same sort of thing with respect to Rhode Island. If the boat begins to show up in Nantucket, Kerry will get a tax bill.

Obama was spouting off about how important the Jones Act was to his administration and in fact, it delayed action on the Gulf disaster... so I posed it as a question...

I threw it out there, and if he ever charters it to a party of 13... I hope he gets nailed for it. Time to hold the elites to the same rules that they stick us with.

Legal maneuvering or not, Massachusetts voters will see Kerry for what he is.

Based on the history of Massachusetts voters, I wouldn't hold out much hope for that happening.
