Sen. John Kerry in Violation of the Jones Act?

John Kerry was busted for trying to evade high Massachusetts taxes for his new luxury yacht by berthing it in Newport, RI - very far from any of his residences, and surely a tax cheating ploy by this tax & spend Democratic sanctimonious hypocrite.

The part of this story that people seem to have missed, comes when his Chief of Staff, David Wade denied that the old poodle was berthing his boat out of state to avoid paying his own taxes to his own tax-ridden state.

“The boat was designed by and purchased from a company in Rhode Island, and it’s based in Newport at the Newport Shipyard for long-term maintenance, upkeep and charter purposes, not tax reasons,”

The fact that he plans on chartering a foreign built boat out in US waters now makes him clearly in violation of the "Jones Act" and "Passenger Services Act" which require that any boat that takes on charter passengers in US waters be built in the USA.

Kerry was obviously looking to avoid paying about $500,000.00 in sales and property taxes that the Democrats imposed on us little people. His spokesperson has lied to get him out of one boiling pot and placed him squarely into another. So which law is he flouting -

He’s a tax evader for sure, but the yacht is technically owned by an LLC in Pennsylvania. That’s Mama T’s legal residence for tax purposes.

Jones act was cited as the reason the aid ships offered to help with the gulf spill were initially told no. It took an exemption months later for them to be allowed in.
Mind you,from what i’ve read Obama could have told congress we need this temporary exemption and would have gotten it right away.

It doesn't matter who owns it, the Jones Act is crystal clear in that any boat which sails between any two US Ports must be:

Exemptions are available for boats that carry less than 6 and 12 passengers. Highly unlikely for a multi-million dollar 75 footer.

My case is about the Jones Act angle, not the tax angle.

Great! I'd like to see Kerry continue to use all of these excuses to defend his buying a foreign built boat and birthing it in another state to avoid paying taxes. Legal maneuvering or not, Massachusetts voters will see Kerry for what he is.

Yes. I doubt that anyone could charter it sans captain or crew (i.e., bareboat basis). Rough approximatation for captain salary used to be about $1,000 per foot but that may be low given the area and a host of other factors. The entire electronic suite onboard boats these days is pretty complicated and mechanical knowledge required to run them can be daunting, not to mention seamanship considerations.

Boat hull, superstructure made in China( ? ). Check.
Finished in New Zealand( maybe ). Check.
Bought by the trust fund ‘investment’. Maybe. Check.
No Sales Tax. Check.
No yearly local tax. Check.
Expenses, crew, fuel, dock, maintenance ALL dumped in ‘Charter Account’. Check. ( Not like you little personal car owners who only get a bit taken off. Suckers ).
Use the boat, fuel, crew, food, booze, dockage for personal fun. Check.
Take losses and apply to earnings, thus lower taxes. Check.

Hmmm, so was Bob Kerrey, former Gov & Senator from Nebraska. He got his Med of Honor by ‘disobeying’ orders...he went ashore and turned the wrong way into a mine field and got his leg blown off. For that he was awarded his ‘hero’ status.
