A fight the IRS question

Over the last couple of years I have been battling the IRS over a persecution issue. They admitted their wrongdoing and after some negotiation a settlement amount was agreed upon. All of the papers were signed and I was waiting for my check to be mailed.

THe IRS then backed out of the agreement and I have recieved notice they want to take this to court because the amount tha they agreed to was too high.

My question is; how can they do this when they had already agreed to the settlement amount -- an amount they put forward and I agreed to?

Here are your three options.

1. Hire counsel. What he will charge you will be greater than what the government is offering. But you get the win.

2. Fight yourself, maybe win, maybe lose, but you are forever on the IRS crap list.

3. Take what they give you and be thankful.

And this is what is wrong with our country. Because this is what our lives have turned into.

I’m not a tax attorney, but I did stay at a Holiday Inn Express last night.

Because they’re the IRS and you’re pipsqueak prole...that’s how...now get back to work, slave...

I have a team of tax lawyers both here and in DC. That's the only reason I got a settlement in the first place.

I just can't see anything remotely legal in the kind of logical gymnastics the IRS is capable of and I'm wondering about if I should bring criminal charges and bring in that type of counsel

Actually, the rules are equal, YOU could also protest the Settlement even after the Agreement. The IRS gives you multiple options for any of the Lein/Levy processes, Pre and Post “agreements”, and then the IRS promptly takes those same “instant replay” rules and can apply it for themselves.

I wish I had an answer for you which would be of benefit to you and yours. Regrettably, We the People are now experiencing the new and improved, New World Order. I wish you all the best in this battle. I can only think of all the treaties made with the American Indian Natives. Probably you should forget it as they're a protected species (federal employees) but discuss with your counsel for peace of mind.

From my own personal experience I'd recommend otherwise. I spent close to 20 grand back in the 80’s with tax lawyer fighting the IRS. He raised point after point, and stopped the IRS in their tracks. Except no matter how many battles we won, the war kept on going - till finally I ran out of money.

I had seen several signs around town that advertised, “Enrolled to practice before the IRS.” One that I drove by frequently also said, “Former IRS Agent.” With my money money supply dwindling, I said what the heck and stopped-in. To make a long story short, $1800 later my problems were fixed.

I've since heard similar stories from other people. I think if you want a high moral victory, hire an attorney. If you just want it over, get an ex IRS agent.

Well, if papers were signed, that in itself is breaking a contract I should think.

Absent details on the case, I can’t say what’s criminal or not. With the litigation pending, I know you can’t.

I am not a lawyer.

The same thing happen to the William Rockefeller family over donating Jekyll Island ( home of the Federal Reserve). The IRS agreed on the value of the island, then changed their mind. The IRS took them to court and lost, why because their lawyer went to court and the IRS had 10 lawyers against him and told the jury what if this were you and the IRS went after you with 10 lawyers paid for by taxpayers.

You are having an "IRS AHA!" moment.

It is well known that whatever one IRS office giveth, another may taketh away. Stunningly simple technique.

New Agent. New Office. New Case. Same Taxpayer. Same ISSUE. I believe in golf they call it "Taking a Mulligan." Except in this case, you, I, or another taxpayer is the ball.

While it is easy for someone who does not have a dog in the fight (in reality we all do) to give you an unbiased opinion I would like to challenge all freepers to fight this kind of abuse wherever and whenever possible.

The IRS has managed to position themselves 180 to the constitution with their “you are guilty until you can prove yourself innocent” approach and for the most part we are all guilty of caving in.

The IRS is banking on the opinion that unlike the ruling class most of us are afraid of our government instead of what it should be and that every politician, every bureaucrat should be afraid of the citizens.

What would have happened if the founders had not challenged the King?

I have even gone so far as to call, write, report any traffic violations by people in government cars of any type. These are OUR SERVANTS and they are supposed to respond to our will.

Someone posted they have all the guns. Well actually we probably have more in numbers although few of us have tanks, nukes, F15s... but the government might even wake up some liberals if they used these on their own citizens.
