Machine Guns WEREN'T Banned? (Hughes Amendment fraud by Charlie Rangel)

Background: In 1986 an amendment called "The Hughes Amendment" was allegedly attached to wider firearms legislation in The House and passed. This amendment made unlawful the private ownership of machine guns manufactured after 1986.

Today, you can own a machine gun, but the Hughes Amendment, H.A.#777, effectively created a "sinking stock" of such weapons that will eventually dwindle to zero as they wear out. Hundreds of people have been convicted of violating this law since, some when their weapons have malfunctioned rather than being intentionally modified.

There's a problem with this law, however. It appears that the amendment was never actually passed.

Archival footage of the actual House session has been found and is reproduced here.

Note who's standing up there with the gavel. That's Chairman Rangel. Yes, that Charlie Rangel. And by the way, you can see quite-clearly that The House Committee at the time was damn close to being in full-on revolt at the time Rangel was allegedly "Chairing" it!

Watch the video. It is quite clear that not only did the voice vote on the amendment fail but in addition it appears, if someone hasn't tampered with this video, that there was an electronic recorded vote that went down on the question as well. (more at link)

Law or no the BATFE passed regs that everyone now pretends have the weight of law. And the convictions show his to be true. Wonder if the convictions are for breaking the law as “passed” (or not) or for violating the regulations as written?

There’s a bubba over on ARFCOM that is planning on talking to a couple lawyers and see if he can’t find a way to get “standing” on this issue and run it up the Courts. Hopefully, without getting his dog shot in the process.

Wouldn’t the easy route be to find someone who was convicted for posession of a post 1986 weapon and go to the court to get the conviction overturned?

If the video is accurate the amendment to the Voelker (sp)Substitute did not pass but the “Voelker Substitute as amended” did. I don’t know if there were other amendments prior to the vote on this one but it sure looks like the subject amendment never made it to the Voelker Substitute.

Interesting.

So, was the first vote or the second vote for the Hughes Amendment. I believe that the third vote was for the overall bill.

Also note the confusion over calls to clarify which Amendments had made it on to the final bill and the rush to vote for the FOPA "as amended".

This was a railroad job from the start.

This story of the fake voice-vote has been common knowledge since 1986. The RATS knew they couldn’t pass a machine gun ban, so they faked it, and the RINOS didn’t have the guts to contest it.

exzactely...FOPA was 'needed to protect gun owners from/dealers from past pnumbras of gun 'control' and was the perfect vehicle to slide this sh!t sandwich into...

from the rangel *smirk* and and drunk o'neils ramrod job of ignoring procedure, it smells of a well choreographed sleight of hand to make the 'nays' *think* that they had won the day...

pity they didnt scream bloody murder once the truth was known then, since plenty of bloody murder has been committed in the name of 'the law' in the last 24 yrs...not the least of which was the branch dividian BBQ which killed a lot of kids...

Yep, these are the kinds of actions we get from so-called "leaders" of a society that supports cheating as just "part-of-the-game" (like intentionally not touching third base on your way to home plate and seeing if you can get away with it.)
