She should go to jail for violating the teacher-student power imbalance. But calling a 16 year old a minor who requires the level of "protection" of life imprisonment of a sexual partner older than a certain age is utterly absurd.
As far as the sex is concerned, the same acts with someone his own age would pass with a wrist-slap at most, and goes on by the millions every day. The predatory sex laws are massively misapplied - a sixteen year old boy is NOT in need of "sexual protection" such as, for example, a pre-pubescent child. To compare the two destroys the integrity of the law itself.
I was in Boston a couple of winters ago and was caught amid a group of students around the age of ten. A student asked his teacher the difference between a Democrat and Republican and, without hesitation, the teacher said “Democrats like all types of people, Republicans don’t.” I laughed at the obvious hypocrisy.
And before people jump on both you and me, we are NOT talking about the case of an 18 yr old and a 17 yr old who do this (even though I would say we would not be in favor of them doing that at that age and being unmarried). we are talking about adults and especially adults in positions of trust and authority over said children, who are supposed to be acting in loco parentis or otherwise shouldn’t be bugging a kid that isn’t their own in the first place.

That's not a short answer - that's a bumper sticker. A short answer is a summation of a position that has a long answer to back it up. In this case, the issue is the application of draconian punishment and the legal age of sexual adulthood - two issue which require the most careful thought, and have successful examples in both directions for both issues throughout history across the world.
And yes, I am talking about morality.
