I don’t see evidence of date rape here. They were young and drunk and she probably was agreeing at the time. The forgetting afterward doesn’t make it rape; that would be unfair to men.
Maybe she was incoherent and unable to make a decision and then it would be date rape, but it’s not if she appeared ok and agreeing at the time. Women have a choice not to drink too much before they get into a strange situation.
