Interesting photo. I have a power chair with 14 inch wheels that I use for doing yard work: running the battery powered weedeater, trimming tree limbs, weeding flowerbeds, taking the trash bin to the bottom of the driveway, etc. Those scooters are not meant to go on grass, but a chair with 14 inch drive wheels can go in grass with ease. The main thing is to not go ‘side-hill’ because they will tip over sideways.

I imagine if I called the police because some woman was sprawled out, drunk, on my lawn AND I witnessed her crashing her scooter.. I would expect them to arrest her for something. I am not talking about punishment but to take her into custody for her own safety. If they simply left, I would be outraged that they did nothing to prevent an intoxicated woman from injuring herself. I can only assume that driving/operating a scooter drunk is illegal if driving a lawn mower or pushing a baby carriage drunk is illegal.

Well, it's obvious you and those of your mindset held sway on this, so you needn't get all worked up. My opinion is simply that there were alternatives to charging this lady with DUI, which may certainly have been within the letter of the law, but IMHO, falls short of the spirit of it.

If she can't walk, her wheelchair is her alternative, and she should have been charged (or simply handled) as an incapacitated pedestrian. If she was creating a public nuisance, fine...charge her with public intoxication or disorderly conduct, but DUI is just way over the top. JMHO.

You are still avoiding the fact that she was operating a motorized vehicle while impaired. Those wheelchairs weigh in excess of 100 pounds and at any speed could cause bodily injury to others.

Have you ever been struck by one of those carts in WalMart? It hurts!

Yes. In fact I've had my foot run over by somebody in an electric wheelchair. Guess I'm just man enough that I didn't have to call the cops and have them ticket the person for reckless driving. I accepted the person's apology and walked it off.
