Mother fined $535 after daughter, Skylar Capo, 11, saves endangered woodpecker from hungry cat

Never let a good deed go unpunished.

An 11-year-old Virginia girl trying to rescue a baby woodpecker instead earned her mother a $535 fine when it turned out the bird was a protected species.

Skylar Capo saved the bird from the clutches of a cat which was about to turn the feathered friend into lunch.

"I've just always loved animals," Skylar told WUSA-TV. "I couldn't stand to watch it be eaten."

When she was unable to find the baby's mother, she asked her own mother if they could adopt the orphaned bird.

"She was just going to take care of it for a day or two, make sure it was safe and uninjured, and then she was going to let it go," said Skylar's mom Alison Capo.

As they were headed home they stopped into a store and brought the bird inside where they incidentally encountered an officer from the Department of Fish & Wildlife.

The officer informed them that the bird was a protected species, and it was illegal to transport it.

Indeed. I have a few barn cats to keep the mice down. But when I come across a feral cat on my property it gets shot. Period. By the way, dogs that chase our cattle get the same treatment.

Locally some people rescued and fixed up a bird with a broken wing. Because it was a migratory bird they were told they could not keep it, so they turned it over to Fish and Game.

Because it could not be returned to the wild, Fish and Game killed it.

It gets worse. According to the linked video report, the Fish and Wildlife officer later went to the mother's house along with a state trooper and served her with papers for a $535 fine and an order to appear in court. If convicted, the mother could face up to a year in jail.

The very first thing we as citizens need to do is at every level of government remove the immunity given to government officials when they abuse their power.

These people were bullies or bed wetters when they were young and found a job where they could bully or pee on us with immunity.

Why, just because you receive a government check, should you have special status?

It is time to reign in JBTs at every level.

You just have to read “A Modest Proposal” by Harold Fickett. As twisted as that satire is, real life is even more twisted. I remember talking to a DNR, there was a black panther running around. I asked her if they got it yet and she said which one? I said what other one? She said the one a sheriff deputy shot. The UN was called in to investigate because it was a protected animal. Then she said that no one would ever hear of a cop shooting another protected species of any kind - shoot shovel and shut up.

It is the same in Florida. In fact (at one time at least) Fish & Wildlife officers are empowered to do warrantless searches should they have reasonable expectation that a crime is being committed such as poaching. This was because of the likelyhood of any evidence being destroyed before a warrant could be issued.

They are also armed not only because of their official function but because they are also very likely to come across other illegal activity that has a preponderance for violent encounters such as drug smuggling and large scale pot farms and meth labs.

Yeah it was hare brained decision. But lots of times LEO are given no choice when it comes to whether to enforce a law. They are told “no exceptions” and that it is up to the courts to decide if the enforcement had merit.

Sadly for every one who agrees fining the mom was dumb you will have someone wanting to know why she got away with breaking the law if she was not fined.

Don’t blame the LEO for being giving bad laws to enforce. Don’t blame them for being told to leave personal judgment out of it. Most LEO do not get to use such discretion any more.

how come the names of the child and her mother were plastered all over the place but...the name of the woman at the fish and game or whatever it is called... her name wasn’t posted???? Why only the name of the people who were rescuing a bird? Who could sit and see a tiny helpless bird about to be killed by a cat? This is a ridiculous case and if the mother was ever sentenced to a year.... there would be real trouble. I mean think about it. Casey Anthony was set free after her child was found dead and walks. This mother would go to jail? I DO NOT think so.

I was out on one of the boats the other day and was pulled over by Game Wardens. Yea, Game Wardens. Who in Texas can pull you over and pretend to be the Coast Guard. I always pull out the life vests, etc. they will want to see and display them before they get to the boat. So everything was mostly ready when they pulled along side. In this case it was two gals all dressed in black, out in 90+ degree weather. After a glance at them it took my brain about 2 seconds to scream "lesbian/dykes". I mean really, thesw two were so butch it was funny. I found myself laughing at them and saying "nice guns, ya got bullets?"

Now usually, if you tweak some folks with guns and badges they get their backs up. But not these two, they were too busy looking at the reason they pulled us over. And that was the babe in her bikini who was decorating the boat at the time. Who, like any good first mate was bending over digging around for something these two uniformed dykes wanted that I had not given them. As she did this I came to realize she was having fun with the two ladies in black. And maybe a little with me too because I know she knew where one item was. It was actually kind of fun because she is, let's say, perfectly built.

Anyway, the point is why do we have so many people doing so many things for the government that we just don't need?Because shortly after we finished with the Game Warden Lesbians I saw the Coast Guard. Who, in contrast to the Game Wardens are real pros. Most of my interactions with the Coast Guard are kind of fun.

We have way too many people working for the government and many times they duplicate things. I've never been able to understand why we have a Federal Dept. of Education. Maybe we need to appoint Donald Trump the "czar of your fired!" and let him start canning some of these people.

So if one of your cows escaped, you would have no problem with a stranger shooting them, correct?
