5-Year-Old Handcuffed, Charged With Battery On Officer

STOCKTON, Calif. (KCRA) -- Earlier this year, a Stockton student was handcuffed with zip ties on his hands and feet, forced to go to the hospital for a psychiatric evaluation and was charged with battery on a police officer. That student was 5 years old.

Michael Davis is diagnosed with Attention Deficit Hyperactivity Disorder or ADHD. His mother says it has led to fights at school. But when the school district said it had a plan to change Michael's behavior, his mother says things went wrong.

"Michael is energetic," Thelma Gray said. "He is one big ball of energy."

Gray calls Michael a comedian. She says his biggest problem is his ADHD stops him from thinking before he acts or speaks.

"He's very loving," Gray said. "He's a good kid and he's not the discipline problem that he was made out to be."

Those discipline problems include fights with other students, even throwing a chair.

Gray says the school, Rio Calaveras Elementary of Stockton, wanted to change that behavior by having Michael meet with a school police officer.

Did the officer hog-tie and charge the child right before or after the mandatory anti-bullying classes?

Having said that, I have no problem with whatever physical restraint is necessary if the kid is presenting a threat to himself or others, but how much restraint is necessary for a five year old? And criminal charges?!?!?! WTF?!?!?!

Joe the five year old was on America’s Most Wanted last week! Yea really! He is wanted for grand theft auto. (stole a neighbor kids toy car)

Yea Joe he is a hardened criminal I tell you. Headed for Sing Song prison this one is.

Sounds like he is allergic to male authority figures. What he needs is a strong father in his life who’ll discipline him properly until he learns to control himself.

This isn’t the first time I have seen stories of 5-9 year olds assaulting cops on FR. lol. Mean little farts. heh

Those cops deserve medals. lol.

He's 5 years old. He's got BRAT disorder. And parents that probably should have stuck with puppies or cats for companionship. Or maybe pet rocks.

This just plain embarrassing to read all of the over educated numb skulls that had to get involved in this train wreck of incompetent parents vs incompetent administrators and bloated bureaucratic system. I'm so glad the government confiscates my money to fund this sort of thing (read: crap).

Flame throwers ready.....the odds that this kid has an organic medical problem are no better than 1 in a thousand, probably not even that.

What’s the sex and size of the officer? UMass recently had a 4 foot 10, Asian, lesbian chief of police (don’t get me started). She would have had to shoot this kid to control him.

Cops are not your friend anymore and certainly not someone to look up to as a role model. As demonstrated by this brave example of todays police officer. Good thing the kid didn’t have a dog

I was just going to say, Child, that I bet this kid has a food allergy and needs a stripped down diet that doesn't involve lots of carbs and high fructose corn syrup.

They wanted to label my son ADHD. He wasn't. He was hypoglycemic. Changed his diet and no more problems.

But then again, hypoglycemia doesn't qualify for additional federal funding. They weren't interested in him from that point forward.

So glad I decided to home school when he got older...

Researching this info. My son has had NO behavior problems until we brought home his baby sister. He had breast milk for the first year and homemade baby food. When I had our daughter things went kind of haywire. We are now back on track nutritionally, but now my son has some seasonal allergies he just can't kick. We took him off dairy because it makes him produce even more mucus and subbed his whole milk with juice. Even though it is all-natural there is no fiber to counteract the sucrose. I just ordered a Vitamix blender from QVC. My hope is that adding whole veg to his fruit will counterbalance the sucrose.
