Netflix subscribers offered class-action payout from Wal-Mart

NEW YORK (CNNMoney) -- Millions of current and former Netflix customers woke up Wednesday to an e-mail about a class-action lawsuit involving the price of online DVD rentals.

It's legit, and it's the latest twist in a legal saga that started two years ago.

In May 2005, Wal-Mart and Netflix struck a pact: Wal-Mart would scrap its struggling DVDs-by-mail subscription service and instead encourage its customers to sign on with Netflix. In return, Netflix agreed to promote Wal-Mart's DVD sales business.

As a rule, I shred Class Action suit notices. I have been part of a “class” for a number of actions (like the “overcharging” by a few pennies a month for my auto insurance payment processor).

These are always big numbers of people affected by small technical violations and only results in instantly rich lawyer a-holes like Edwards.

Unless and until I have been directly affected by significant malfeasance by a company that puts me in a class, I will eschew any payments (those O So Valuable $2.00 off Monday Carwash coupons) from any Class Action settlement.

Including this one (I got my notice last week).

Most class action lawsuits seem to only benefit the lawyers.

It’s ok to hate the idea of these borderline-extortion lawsuits, especially as the “damages” are a few bucks at best and lawyers get the big payday. But not participating doesn’t mean that the lawyers get any less of the money.

But not participating means that company which has been targeted (almost always unfairly) at least saves a few shekels. It isn’t much but I can’t take blood money, even if it is a coupon for 2 bucks off a Monday Car Wash.

Call it the “yelp” factor (/Horton).

No it doesn’t work that way. They have a pot of X million dollars to be divided among however many people are in the class. If half the people take your action and opt out, then the remaining half get twice as much as they would have otherwise.

You’re not saving the victimized company anything by opting out, but I respect your philosophy of not taking “blood money”.
