Five killer whales have been named as plaintiffs in a lawsuit which argues they deserve the same constitutional protection from slavery as humans.
A US judge is considering a complaint by People for the Ethical Treatment of Animals' (Peta) against SeaWorld.
It is reportedly the first time a US court has heard legal arguments over whether animals should enjoy the same constitutional protections as humans.
SeaWorld's legal team said the case was a waste of time and resources.
The marine park's lawyer, Theodore Shaw, told the court in San Diego: "Neither orcas nor any other animal were included in the 'We the people'... when the Constitution was adopted."
He said that if the case were successful, it could have implications not just on how other marine parks or zoos operate, but even on the police use of sniffer dogs to detect bombs and drugs.

I heard this PETA attorney interviewed on the radio yesterday. Even though his arguments were persuasive, they didn’t quite cover up the fact that he’s a raving moonbat.
I generally don’t resort to name calling, but in this case, he’s earned an exception.

At issue here:
1. Courts have given standing to environmental groups.
2. How to overturn this fundamental mistake in jurisprudence?
3. In the mean time, why haven’t conservative groups created their own “environmental groups” in order to gain standing in federal courts? These could then exploit this entry mechanism to the courts to advocate for all sorts of conservative principles, whether they had anything actually to do with trees and whales and snail darters or not.

He Gives a good account of what is going on here. He even did a CSPAN Book Presentation. This tactic of suing in the name of the animals name is one of the tactics that he has described them trying to use.
Apparently, PETA doesn’t have enough to do.
Free Willie comes to mind. After at least 2 years of trying to reintroduce Free Willie to the wild, he was not accepted into any whale pod and died.
With liberal morons like PETA, it is the action and NOT the end result that counts!! They cause far more damage and harm to the animals they claim to protect than the organizations they sue!!
These PETA wackos believe that you and I should not be allowed to OWN a dog, cat, horse , cow, chicken, sheep , pig or ANY kind of domesticated animal. They are nuts.
The have stolen dogs from AKC dog shows. They have stolen dogs from responsible breeders.
There would be no dogs today without “artificially engineered by centuries of forced breeding”. What they fail to mention is that dogs live happier and longer lives because of selective breeding has eliminated many genetic defects in many dogs. What they also fail to mention is that the lack of dogs available to shelters has led them to import stray dogs from Mexico and the Carribean. Many of these dogs carry diseases such as rabies that have been eradicated in US dogs for years.
All true. The word has to be spread because most people don’t know all of that, nor that HSUS is cut from the same cloth (and does not support shelters but is a lobbying group). I think the real animal rights hard core are just control freaks, just like other liberals, only their schtick is non-human animals. But it’s the same old song and dance, they want us to do what they want us to do.
