If Breitbart was assassinated, it could be perfectly legal under current US laws and policy.

CIA Lawyers Maintains Citizens Could be Targets if they are at War With the U.S.

The Associated Press has reported that top national security lawyers in the Obama administration have determined that U.S. citizens are legitimate military targets when they take up arms with al-Qaeda.

Answering questions at a national security conference Thursday about the CIA killing of Anwar al-Alwaki, a radical American-born Muslim cleric who Obama descirbed as "the leader of external operations for Al Qaeda in the Arabian Peninsula”.

Al-Alwaki had been killed in a September 30 U.S. drone strike led by the CIA in the mountains of Yemen. The radical, whos fiery sermons made him a larger-than-life figure in the world of Jihad, had long eluded capture by CIA and Yemeni security operatives.

However, in 2011, after days of surveillance, the New York Times reported, armed drones operated by the CIA took off from a new secret American base in the Arabian Peninsula, crossed into the northern Yemen border and rained a barrage of Hellfire missiles at a car carrying al-Alwaki and other top operatives from Al-Qaeda's branch in Yemen.

According to the AP, the government lawyers - CIA counsel Stephen Preston and Pentagon counsel Jeh Johnson - did not directly address the al-Alwaki case. But they said U.S. citizens don't have immunity when they're at war with the United States.

Johnson said only the executive branch, not the courts, are equipped to make decisions about who qualifies as an enemy, the AP reported.

What is a weapon?

Is someone who threatened to end the Obama presidency "at war" with the U.S. in the eyes of the president?

IF the president determined that Andrew Breitbart's release of video of his college days would threaten his presidency, and
IF the president believes his presidency is essential to the continuation of the US government,
THEN the president would be OBLIGATED to remove the threat.

As such he would be required, in his own mind, to issue a presidential finding that Andrew Beritbart needs to be eliminated before the videos are released.

The CIA, would legally be bound to follow the presidential directive and eliminate the threat in a timely fashion.

After all, destabilizing the US government is an act of war, and in perfect alignment with al Qaeda's goals, isn't it? Isn't it?

Although some of us old fashioned folks, bitterly clinging to the Constitution, might argue that it is a freedom of speech issue…

And I would agree with you on that under most circumstances, including the most likely ones, which are

A: he did die of natural causes (which I believe) — or
B: he was killed, but with an untraceable substance that affected the heart. You know, something Bill Ayers might have slipped him Super Sunday.

There is an option C or D, but I don’t want to speculate on those, because the reality is almost certainly A, and if not A, then B, and under either, you are totally correct.

Obama has the power to murder and disappear US citizens. His Homeland inSecurity thugs have named conservative groups domestic terrorists. The Democrat party and media has named the Tea Party terrorists. Andrew took out Obama’s corrupt election machine - ACORN.

From now on, we can never know for sure who our President is murdering and diappearing. The American government, under Obama, has turned on the citizens of America.

Interesting the media was claiming his death was of natural causes before an autopsy was conducted. Perhaps an Operation Mockingbird disinformation operation

That was very odd. A relatively young person dying suddenly who is very politically active and has political enemies. And yup, right away, natural causes.

Really? Selling arms to Iran is AOK? I had no idea. Aren’t they using them against us now? I don’t know much of this story but in the 80’s I remember hearing a bit (I was young). Didn’t Colonel North go to jail? Seriously didn’t hear much about it.

I watched NBC's The Firm last evening. The theme of the episode was the FISA court and the authorized killing of a US citizen.

It was interesting, and scary, to think this kind of thing might be going on.

The episode, Chapter Nine, is worth watching in light of this topic on NBC.com and may be on your local cable On Demand and on Hulu.com.

It burns me how our guys, and not the enemies of our republic need security for merely exercising their 1st Amendment rights. Coulter, Rush, Horowitz, . . . all take various measures. Where is the outrage? It is just accepted that conservatives should face physical danger.

I have never heard reference to security details for the Marxist mouthpieces bent on our destruction.

What exactly was Breibarts heart condition called, anyone know? I haven’t read this anywhere.

Heart conditions are funny, sometimes a thing as seemingly unrelated as gingivitis can set off the big one. I don’t know if he was snuffed but I wouldn’t doubt for a second that the present administration would do it AND has the un-official connections to bring it off.

There were rumors about Marilyn . She had been with RFK and JFK. Given the recent revelation from the former mistress of JFK and his penchant for telling her to have sex with someone while he was present...it is quite possible Marilyn was involved with both of them.

Breitbart didn’t look well. He was only 43 but looked much older.

That is not to say that the CIA didn’t take him out.

Think about the KGB. If they wanted to kill someone they could make it look like natural causes. Or they could just not care what it looked like because it was Russia ...so they off someone with plutonium as a warning.

Yep, AB sure was a Bright & Shiny Beacon of truth. He had the guts to do stuff that most will not. I will truly miss him. His turn from crazy lib to hardcore conservative is a great story to be echoed throughout the land.

Twenty years ago we never would have thought about political assasinations everytime a politcal figure died suddenly. Times are strange now, and what was unthinkable 20-30 yrs ago....now is not so “weird”.

Huh? Political assassinations the world over may have even happened more 20-30 years ago than they do now. The information age and the 24/7/365 media lens that goes with it probably make this sort of thing even more difficult now than it once was. Human nature is what it is. Nothing has really changed and times are no stranger now than they have been in the past.

There is no reason to think Breitbart was assassinated at this point. Speculating and obsessing over it is about as useful as arguing that the CIA killed Tupac.

I've read different things.

He had previously suffered from heart problems in the past year but doctors were unable to pinpoint the cause. He was 43 years old.

Sources said officials will also try to determine whether Breitbart had any underlying health problems that could have contributed to his death, a common tack in such cases.
