Why Justices Ginsburg and Breyer should retire now
CBS News ^ | April 28, 2011 9:58 AM | Randall Kennedy

Justices Ruth Bader Ginsburg and Stephen Breyer should soon retire. That would be the responsible thing for them to do. Both have served with distinction on the Supreme Court for a substantial period of time; Ginsburg for almost 18 years, Breyer for 17. Both are unlikely to be able to outlast a two-term Republican presidential administration, should one supersede the Obama administration following the 2012 election. What's more, both are, well, old: Ginsburg is now 78, the senior sitting justice. Breyer is 72.

Either way, a president that makes a habit of appointing LIBERALS to the bench will be in power in 2013, so the might as well stick around.

It’s CBS news. They want Obama to replace them.

They just want The One to be able to put two more young extremely leftist liberals on the SCOTUS now as he will lose in November.

I am hardly a Romney fan, but even I don’t believe their choices would be the same. I just don’t. Consider a 2nd term marxist who doesn’t have to give two sh1ts about ANYTHING or ANYONE and his picks, versus Romney’s potential picks, and you can damn well bet he will care about getting re-elected again.

“Both have served with distinction on the Supreme Court for a substantial period of time”

With the distinction of being the two worst justices on the court until Obama started appointing.

Probably not exactly true, but it was the first thought that came to mind. Served with distinction my @$$.

Because partisan politics should always be the prime consideration for the court.

*sigh*

In spite of her age and poor health, Justice Ginsburg “hangs on”. Why is that?

A hard leftist she may be, but she is also a Jew. I believe that notwithstanding her political leanings, she sees Obama for what he is, a Muslim sympathizer at the least, or an outright Muslim, period. As a Jew, I sense she will not provide a him the opportunity or satisfaction of filling “her seat”. I sense that, deep down, she despises him, and is determined to outlast him...

I could be completely wrong, but that’s how I see it...

They will retire if Obama loses. Then Harry Reid will put replacements through in a lame duck session. The Republicans will cry about procedures, but cave as always.

Dear Randall,
Ginsberg and Breyer are liberals.
They’ve never done anything “responsible” in their life.
What makes you think they’re likely to start now?

Actually, the GOP should start now to refuse to nominate any Obama court appointees to any court: federal district, appellate, and Supreme Court included. Then go all-out to keep the House and win the Senate in this year’s election (and hopefully the White House as well, but I expect Romney to nominate a lot of sterling GOP judges cast from the same mold as Souter and Stephens). If the GOP then controls both houses, it should decrease the size of the SCOTUS every time a liberal justice retires or goes toes up.

And we need to impeach Kagan for participating in the ObamaCare decision.

Do you have any facts to back up your feeling that Ginsburg as a Jew distrusts the muslim in the WH?

I wish that it were true but there are still many many Jews supporting the muslim. Jews are frequently so smart but they have such a huge blind spot when it comes to liberalism.

Refuse to CONFIRM, not “nominate”. Let Zero nominate until he’s blue in the face, just don’t confirm any further nominations at any court level.

Of course, the GOP’s problem with such a strategy would as always be with senators of the likes of McCain, Graham, Brown, and the nitwits from Maine.
