OK is there ANY "Silver Lining" to today's ruling?

“Congress cannot be the sole judge of the scope of its own powers. Today a majority of the Roberts Court reaffirmed this vision.”

The very fact that SCOTUS reviewed the law at all told us that. So did a million previous decisions. That’s what judicial review is all about. We’ve known since Marbury v. Madison at least that Congress isn’t its own judge.

This is drinking piss and calling it lemonade.

I agree - and the Constitutionality of the tax/penalty will be challenged if the legislation survives long enough for someone to pay the tax/penalty and then have standing to challenge it.

The government didn't order me to buy a house - but they sure as hell assess a tax ‘penalty’ for not doing so. The government didn't order me to marry my fiance - but there is a significant tax ‘penalty’ for doing so as long as she continues to work.

I think this health insurance thing is the reducto ad absurdum of this exercise of government power - that or ordering you to buy a pound of broccoli per month or be assessed a tax / fine - and hopefully people will see it for what it is and insist that they cut it out!

Much like Kelo vs New London sparked a lot of laws protecting property rights - sometimes it takes a blatant and ugly over-reach before people get mad enough to SMACK that hand!

I hope November (and after) is a display of this sentiment.

How’s this, maybe this capricious ruling by a rogue SCOTUS will force the necessary small percentage of citizens to resist this tyranny NO MATTER WHAT THE COST!!!!

Roberts has just parsed the language and created something that didn’t exist: a tax.

NOT!

The arguments were presented to SCOTUS as follows:
1 - find for it under the commerce clause - DISAGREED
2 - find for it under the necessary and proper clause - DISAGREED
3 - find for it as a tax - AGREED

Read Roberts opinion:

"The Federal Government does not have the power to order people to buy health insurance. Section 5000A would therefore be unconstitutional if read as a command. The Federal Government does have the power to impose a tax on those without health insurance. Section 5000A is therefore constitutional, because it can reasonably be read as a tax."

Just because it was argued before the court to be a tax does not mean it was one. The law as written clearly makes it a penalty. From the time it was proposed to this morning Dems denied it was a tax. It is not a tax.

I agree. They needed it to be a penalty to pass the Congress, so it was a penalty. They needed it to be a tax to pass the courts, so it became a tax. They need it to NOT be a tax to get reelected. Rest assured, the commies and MSM will be in full-scale "it's not really a tax" mode by tomorrow at the latest.

Damage control will begin no later than Sunday morning as they begin to spin this back into a penalty. They will mention that the term "tax" here was only applied in a very technical, legal sense, but that in a practical sense, there is no such tax. And many will buy into it and actively promote it.

In short, to advance communism, it is whatever they want it to be, whenever they want it to be.

Is there not a silver lining in all of this? As Justice Roberts so elloquently stated, “The individual mandate is a tax.” This is something Obama and his legion of lawyers argued against from the very beginning...I suspect for good reason. If the court had ruled that Obamacare was constitutional as something other than a tax...then there would have been no way out of this,except by repeal with a republican president. While I am not a fan of the current condition of the supreme court, I suspect I have no other option than to look on the bright side of things....while I prep for our impending doom. I digress...nevertheless, if the supreme court has ruled that it is a tax, and that Obamacare falls within the governements power to tax, has the supreme court not masterfully left an out for the American people. Are taxes, under the right conditions, repealed and or done away with? I don’t know...someone more educated on the subject than I educate me. Certanily, this is not the same country I fought for.

Thank you. Trying to make chickensalad out of chickenshit is desperate delusion. There is no silver lining. Can anyone name one bill passed in the past 100 years that was turned more conservative. Please don't say Reagans tax reforms. You know damn good and well revenues increased to the feds at the expense of the producers despite decrease in rates. They simply say watch the bouncing ball while they corrupt the country. Leftward! Always left. Never more conservative.

There is a war on conservative thought, Christians, taxpayers, intruterine babies, and on and on. You cannot trust your own republican leadership. They are simply more subtle, but they are part of the problem. This is very dangerous for the public.

Hannity is delusional. His intentions are good, but today he is full of crap. There is no good silver lining. The lining is feculent and purulent. This gets very dangerous.

I do believe him. He’s not a Democrat. If he makes repealing Obamacare
a centerpiece of his campaign, I truly believe he’ll have a
filibuster-proof majority, and Obamacare will go on the ashheap,
at least until we get another Democrat as President.

Taxes can be repealed, yes, but so can penalties. Nothing here is gained.
