When I said 'bad law' I meant unconstitutional.
The law wasn't put forth as a tax, it was put forth based on the interstate commerce clause and should have been struck down as such.
The SC simply bailed out the adminstration by giving it the justification for the law as a tax and then claimed it was constitutional.
