Jury finds Apple's patents valid in Samsung trial

A U.S. jury on Friday said Samsung Electronics Co Ltd has infringed some of Apple Inc's patents, and that all of those patents are valid.

The verdict in the high-stakes trial between the two tech giants was still being read in a federal courtroom in San Jose, California, and not all of the key legal findings had been announced.

I would love to buy an iphone, but the screen is too small for my 47 year old eyes and they dumb it down so you can’t customize it, unlike android.

What apple needs to do: Make a phone like the Samsung Note (only available on AT&T, whose network for voice calls in the St. Louis area is unacceptably weak for business purposes). Samsung has sold 10MM Notes - 5.3 inch gargantuan screen great for people who can’t see well and who want to be able to use a stylus.

Unfortunately, Apple is the only game in town for many important apps because the developers ALWAYS develop for the Apple first and some companies whose apps I NEED don’t develop for Android at all.

Apple has only Cult Status and Logistics and some Engineering on it’s side.

Everything else is a result of a closed architecture resulting in high prices that fund lawsuits.

I can say with certainty their software development tools are crap crap from the 1980’s.

Everything from the developers angle is a rehash of old technology.

Nonsense. Xcode 4 is state of the art. As one fluent in Objective C, Visual Basic, Action Script, RealBasic, and MS C++. I can say that Xcode is my favorite IDE. It beats Visual Studio hands down in its simplicity and raw power.

Sansung counter sued for Apple's infringement of core cell technology (unlike Apple's “roundness”). Apple's been one of the biggest benefactors of pirating innovations, but they're too chic to be held accountable.

Xerox’s suit was dismissed because they took too long to file it. Apple was suing MS at the time and if Xerox sued Apple and won then both Apple and MS would have been liable to Xerox. Interesting enough is that Apple didn’t win the “look and feel” lawsuit against MS. Except for one tiny thing, the trash icon.

In 1979, Apple was planning a business computer and arranged a visit with Xerox Parc research center to view some of their experimental technology. It was there they discovered the mouse, invented by Douglas Engelbart while he was working at SRI International (SRI); the mouse had subsequently been incorporated into the graphical user interface (GUI) used on the Xerox Alto. During an interview, Engelbart said "SRI patented the mouse, but they really had no idea of its value. Some years later it was learned that they had licensed it to Apple for something like $40,000."

I don’t have a problem with that. Ny favorite guitar neck company is Warmoth. Fender said, “You’re making our necks! We’re going to sue.”
Warmoth said, “Yeah, we’re making Fender necks. Can we reach a licensing agreement?” They did. And they still make Fender necks that are better Than real Fender necks! Gibson won over their peghead shape. And that was an international case involving Japanese copies of Gibson guitars. And the copies were very good guitars that cost considerably less than Gibson’s inflated prices.

It is a true patent. Patents come in two basic flavors, a utility patent which covers a function action or process, and a design patent which covers, well, design.

A design is the shape and feel of something, a trade dress. The “look” that defines a product line.

Apple knows which of 3-4 hard drives, 2-3 video cards, and controls their BIOS. They have nothing near the variance that the PC has in architecture. The new machines have to be sent to the factory for a ram upgrade.

A $1500 Macbook Pro has parts worth about $500 - 600.

They have the luxury of no competition and only a few new products every year.

How long did it take for window resizing to move from one corner?

I may be wrong about this, but my understanding is that patent and trademark law only applies to protection of designs, materials and emblems/shapes to the extent that the holder needs them to identify the unique characteristics of its own product in comparison to other similar products.

Therefore, the protection of the Coca-Cola trademark on the shape of its bottle would only be enforced in terms of its use for other beverages. If a manufacturer of motor oil or laundry detergent, for example, wanted to use the same shape in their bottles and had a brand name that consumers would never confuse with Coca-Cola, then they could probably do it without running into any legal problems.

See what I mean? The exact same snotty condescending attitude you normally see from your average lefty is personified even in conservatives that project from their love of iProducts.

Quite frankly the attitude of that company is as far from conservative as you can get.

Cant win with capitalism, so get the courts (A California one at that) to rig up the market to protect yourself from other products.

All the while telling us how bad those products are! Cant have the plebs making a decision on their own and buying something that isnt from Apple, can we?

The usual standard is based on determining if the usage would "cause confusion in the minds of the consumers".

Very dissimilar products and services can have similar trade dress, names, shapes, logos etc.

However, your hypothetical detergent manufacturer would only survive about ten minutes after the first child swilled down a bunch from a Coca Cola shaped bottle...

Objective-C was created primarily by Brad Cox and Tom Love in the early 1980s at their company Stepstone. Both had been introduced to Smalltalk while at ITT Corporation's Programming Technology Center in 1981.

State of the art in 1981 (30+ years ago).

I have trust me. Spent a year doing it. It is arcane when compared to Java and C#.

The Interface builder is buggy for IOS and NIBs? It’s much better to manually code screens. Everyone knows that. So why can’t Interface Builder reverse engineer screens?

After using bogus lawsuits to try to block competitors over stuff they did not invent, but rushed out to patent? Yeah I certainly do (HATE) that company and anti-capitalist attitude they bring to the table. And anyone with a brain should be ticked as well.

But the way the typical Apple elitist thinks, as spelled out in the first post of this story, we are supposed to be cheering this? Like how does the free market benefit from that outfit being able to use patents on stuff they did not create to strangle the market in the courts?

Oh noooooo it is not childish at all to have a view of those people similar to what I have to the average O-bot whose drooling worship of his power-grabbing ways mirrors Apples to a tee.
