EXPANDED DEFINITION OF EXEMPT ORGANIZATIONS

What is an Exempt Organization?

In general, an Exempt Organization is not required to access the National Do Not Call Registry, but is allowed access as an Exempt Organization, if one or more of the following is true:

1. Your organization is not subject to either the FTC’s or the FCC’s jurisdiction. For example, a non-profit charitable organization may be an Exempt Organization, assuming, of course, that it is truly a non-profit. Entities that have been granted tax exempt status under the Internal Revenue Code are not necessarily Exempt Organizations for purposes of the National Do Not Call Registry. See, e.g., FTC v. National Consumer Council, Inc., and FTC v. Debt Management Foundation Services, Inc., at http://www.ftc.gov/opa/2005/03/creditcouncel.htm
2. Your organization does not engage in any “telemarketing” or “telephone solicitation” activities, as defined by the FTC and FCC, respectively. For example, survey calls and political polling calls are not covered by the definition of “telemarketing” or “telephone solicitations.” An organization that places ONLY these types of calls may be an Exempt Organization.
3. Your organization qualifies for one or more of the specific exemptions contained in the FTC’s and FCC’s rules, such as:

1. you only call to solicit charitable contributions; or
2. you only call consumers with whom you have an established business relationship; or
3. you only call consumers from whom you have received written permission to call; or
4. you only make business-to-business calls.

If you are a for-profit telemarketer, you are NOT an Exempt Organization, even if you call consumers on behalf of an Exempt Organization, such as a non-profit. See, e.g., National Federation of The Blind v. FTC, 420 F.3d 331 (4th Cir. 2005).

Nah, I prefer not rewarding telemarketers/scammers, etc by answering the phone when they call.

Answered call = Incentive for them to call again.

If I get a call from a poller I will block the number, post it here on the internet and tell others tyo be on the lookout.

Honestly? Don't give any information to any stranger who randomly calls you. If they repeat the call, route their number to an answering machine or block them entirely.

You really don't know who's calling you.

#18 - thanks for the perspective.

We visited LA not too long ago and hit some South American restaurants. Not too many here in the Phoenix area, mostly Mexican which any Islander or South American will tell you isn't nearly the same.

My wife picked up a Latin Periodical that they leave out in the front of stores and restaurants. The stuff they said about obama made our heads spin. They basically claimed all of these tremendous achievements and how things were going "super swell" (in Spanish) because obama had saved the country.

My wife was shaking her head at all of it. This is what they are spoon feeding the Latino population in LA. It's in the paper and it's even more blatant on the big Latin cable channels. I didn't see any conservative counter to it via mass media.

OTOH, Latinos in LA know when they can't find a decent paying job, their business takes a hit and when a general sense of malaise hits society. From there it's not such a leap to realize obama has destroyed the economy.

It's a matter of how many people are willing to do the right thing and see beyond the endless propaganda. Historically, that's much more difficult than it sounds.

Here's to hoping they do see the truth and drop obama come November.

I actually got 2 phone polls the other night. The first I was pretty straight forward but the second I, too, claimed to be a black independent. It was quite fun to mess with them & I hope to get more!
